HomeMy WebLinkAboutCC RES 79-018RESOLUTION N0. 79-18 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVI�G A TENTATIVE TRACT MAP TO CREATE A 142 LOT RESIDENTIAL CONDOMINIUM SUB- DIVISION TO ALLOW 140 DETACHED DWELLING UNITS, a 6 (six) ACRE PUBLIC PARK AND CIVIC CENTER. CASE N0. TT 14003 WHEREAS, the City Council of the City of Palm Desert, California, did, on the 8th day of March, 1979, hold a duly noticed Public Hearing to consider the request of LE�JIS HOMES OF CALIFORNIA for approval of a Tentative Tract P1ap to allow 140 detached dwelling units on approximately 52 acres within the PR-4, S.P. (Planned Residential, 4 d.u./ac., Scenic Preservation Overlay) and P(Public/ Institutional District) zone, located between San Pascual and San Pablo, north of 44th Avenue, more particularly described as: Portions of APN 621-360-001 APN 621-360-005 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has been previously assessed under CZ 09-78 and DP 13-78, and no further evaluation is deemed necessary; and WHEREAS, the City Planning Commission, by Resolution No. 453 has recommended approval of said subdivision subject to conditions; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be - heard, the City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and consti- tute the findings of the Council in this case; 2. The development of the property described hereinshall be subject to the restrictions and limitations set forth herein which are in addition to a11 the requirements, limitations, and restrictions ' of all municipal ordinances and Sta.te and Federal statutes now in force, or �vhich hereafter may be in force. 2. Full public�improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. . 4, Access rights, except.for approved private street entrances on San Fa.blo Avenue, Magnesia Falls Drive, and Public Street �'A', sha.11 be offered to the City as a dedication on the Fina.l bsa.p. 5. The C.C.&R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: a, The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. ; 6. �.= ?. Improvement plans for water and se�ver system shall meet the re- quirements of the respective service districts. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall � be granted to the City of Palm Desert, without cost to the City and free of a11 liens and encumbrances. �. All on-site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision im- provements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access , to all buildings. An adequate number of fire hydrants �vith required fire flo�vs shall be insialled as recommended by the Fire Marshal. "'12. ��Prior to recordation of the Final h4ap , the developer shall furnish •- the original and three (3) copies of.the water system plan to the Fire hiarshal for review. � ----- - -- 13. All requirements of the City Fire r7arshal shall be met as a part of the development of this trµct (from letter dated January 17, 1979). 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the follo�ving certification: "I certify �hat the design of the water system of Tract No.14003 is in accordance with the requirements prescribed by the City Fire blarshal." _:a,-:`: t� ' _ — ��; �. RESOLUTION 79-18 Page four 15. Drainage shall be subject to approval of the City Engineer. Ap- plicant shall provide enaineered data as requested. 16. All private streets shall be inspected by the Enbineering Depart- ment and a Standard Inspection Fee shall be paid. 17. AlI requirements of the Planning Commission action on the Develop- �• ment Plan 13-78sha11 be met as a part of the development of this tract. 18. The total number of lots shall be limited to 142,•plus lettered lots for public and private streets. 19. The applicant shall have twelve (I2) months from ihe date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 20. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall dedicate land as directed by the City Council as a condition of the Final Map, for park and recreation purposes. � CASE N0. TT 14003 RESOLUTION 79-18 Page five SPECIAL CONDITIONS 1. Proposed lot No. 141 shall be further divided and renumbered, as follows: The north six (6) acres shall be separated and bear the number Lot No. 141; and, The balance of the proposed lot shall be renumbered to create a new Lot No. I42. 2. Lot No. 141 (as modified by Condition No. 1) shall be recorded as the first phase of "Final" Tract Map No. 14003. 3. A Final Tract Map for other phases of Tract Map No. 14003, shall not be approved for recordation until modified Lot No. 141 has been conveyed to the City of Palm Desert for public park purposes to satisfy the combined Public Facility requirements for the said tract, and the requirements for Tract 14004, Tract 12181-1 and Tract 12�81-2. 4. Except for approved private street entrances to the Tract, and Lots 141 and 142, the entire perimeter shall be bounded by a six (6) foot high masonry wall to be installed in the initial phase of dwelling unit construction as approved through the Design Review process. 5. Each phase shall be served by full private street improvements and that any phasing shown on the Final Map shall reflect this condition. 6. This subdivision shall pay $1,500.00 per acre (gross acreage) to the Drainage Fund of the City of Palm Desert. 7. Safety street lighting shall be installed at the intersections of Magnesia Falls Drive and Lot A; Magnesia Falls Drive and San Pablo Avenue; San Pablo Avenue and public street Lot A, opposite College of the Desert; and public streets Lot A and Lot E. 8. The storm drain channel adjacent to the easterly side shall be landscaped in accordance with the recommendations cf the Director of Environmental Services. 9. This subdivision shall pay $7,000.00 to the Signalization Fund of the City of Palm Desert. 10. The 100-foot drainage easement shall be sized by the subdivider's engineer for a trapezoidal ditch and excavated. The soil excavated therefrom shall be utilized within the tract. 11. Subdivider shall provide for improvements either in cash, bond, or some form of security agreement satisfactory to the City Manager, as required by City Engineer to extend Magnesia Falls Drive to cross the 100' drainage channel adjacent to northerly side of subdivision, but not necessarily a bridge. _ -� � 1 � • - RESOLUTION N0. 79-18 CASE N0. Williams: provide the following fire protection in accordance with the Uniform Fire Code: 1. Install a water system capable of delivering 1500 GPM fire flow trom any fire hydrant for a two nour duration in addition to domestic supply. The computation shall be based upon a minimum oi 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. 2. Install Riverside County super fire r�ydr•ants located at each street intersectiion (a� but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shal.l be painted chrome yellow, and the tops and nozzle caps snall �e painted g reen. B. C�bs shall be painted red 17 f'eet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer snall furnish the original and three (3� copies of the water system p1an to the F'ire Marshal for review. 4. Tne water system plan shall be si�ned �y a registered civil er�ineer and approved by the water company, with the foilowing certification: "I certify that the desi, of' the water system in Tract No. 14003 is in accordance with the requirements prescribed by the Fire b7arsnal." Upon approval, the original plan will be return to the developer.
