A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW 142
SINGLE FAMILY ATTACHED CONDOMINIUMS.
CASE N0. TT 14004
WHEREAS, the City Council of the City of Palm Desert, California,
did, on the 8th day of March, 1979, hold a duTy noticed Public Hearing io consider
the request of LEWIS HOMES OF CALIFORNIA for approval of a Tentative Tract Map to
create 7 lots to allow for 142 Single family attached condominiums on approximately
27 acres within the PR-4, S.P. (Planned Residential, 4 d.u./ac., Scenic Preservation
Overlay) zone, located between San PabTo Avenue and San Pascual, north of 44th
Avenue, more particularly described as:
Portions of APN 621-360-001
APN 621-360-005
WHEREAS, the Planning Commission, by Resolution No. 454, has recom-
mended approval subject to conditions; and
WHEREAS, said application has complied with the requirements of
the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32",
in that the subject project has been previously assessed under CZ 09-78 and
DP 13-78, and no further evaluation is deemed necessary.
WHEREAS, at said Public Hearing, upon hearing and considering all
testimony and arguments, if any, of aTl persons desiring to be heard, said
City Council did find the following facts and reasons to exist to recommend approval
of the Tentative Tract Map:
1. The subject Tentative Map does substantially comply with
Chapter 26 of the City of Palm Desert Municipal Code, and
the State of California Subdivision Map Act, as amended.
2. The subject Tentative Map does compTy with the adopted General
Plan and the Palm Desert Zoning Ordinance.
3. The site is physically suitable for the type of development
proposed. �
4. The design of the subdivision and the proposed improvements
are not likely to cause substantial environmental damage or
serious health problems.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Council in this case;
2. That it does hereby approve the above described Tentative Map
No. 14004 for the reasons set forth in this Resolution and subject
to the attached conditions.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
City Council, held on this 8th day of March, 1979, by the following vote, to wit:

1. .The development of the property described herein shall be subject
to the restrictions and limitations set forth herein which are in
addition to all the requirements, limitations, and restrictions
of all municipal ordinances and State and Federal statutes now
in force, or which hereafter may b� in force. •

2. �Full public improvemerits including traffic safety lighting as re-
quired by Ordinance and the City Engineer shall be installed in
accordance with City standards.
3. Prior to submittal of the Final Map, the applicant shall provide
the Department of Environmental Services with a list or proposed
street names with at least three alternatives. The approval of
the final street name shall be made by the Director of Environ-
mental Services.
4. Access ri�hts , except for approved private street entrances on San Pa.blo Avenue,
Ma.gnesia Falls Ilrive, and Public Street 'A' , sba.11 be offered to the City as a
dedica.tion on the Final Map.
5. The C.C.&R's for this development shall be submitted to the City
Engineer for review and approval prior to the issuance of any
building permits. Prior to recordation of the final subdivision
map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded.
c. Management and maintenance agreement to be entered into
with the owners of the units of the project.
6. Improvement plans for water and sewer system shall meet the re-
quirements of the respective service districts.
?. Area shall be annexed to appropriate Improvement Districts having
jurisdiction over the subject area.,
8. All dedicated land and/or easements required by this approval shall
be granted to the City of Palm Desert, without cost to the City and
free of all liens and encumbrances.
�. All on-site utilities, including cable TV, shall be placed under-
ground and shall be completely concealed from view except certain
appurtenances as may be approved by the Director of Environmental
Services.
10. Complete plans and specifications shall be submitted as required by
Ordinance to the City Engineer for checking and approval before
construction of any improvements is commenced. The subdivider shall
submit "as-built" plans prior to acceptance of the subdivision im-
provements by the City.
11. In order to maintain reasonable fire protection during the construc-
tion period, the subdivider shall maintain passable vehicular access
to all buildings. An adequate number of fire hydrants with required
fire flo�vs shall be installed as recommended by the Fire Marshal.
��12. Prior to recordation of the Final Map, the developer shall furnish
the original and three (3) copies of.the water system plan to the
Fire hiarshal for review. � �--- - � - ---
13. All requirements of the City Fire P,Zarshal shall be met as a part of
the development of this tract (from letter dated January 17, 1979).
14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the follo«�ing certification: "I
certify that the design of the water system of Tract No. is in
accordance �vith the requirements prescribed by the City Fire hiarshal."

15. Drainage shall be subject to approval of the City Engineer. Ap-
plicant shall provide engineered da�a as requested. .
16. All private streets shall be inspected by the Engineering Depart-
ment and a Standard Inspection Fee shall be paid.
17. All requirPments of the Planning Commission action on the Develop-
ment Plan 13-78 shall be met as a part of the development of this
tract . �
18. The total number of lots shall be limited to 7, .
19. The applicant shall have twelve (12) months from the date of the
approval or conditional approval of the tentative map for filing
of the final map unless an extension of time of up to eighteen (18)
months is granted by a Resolution of the City Council.
20. Drainage and Signalization Fund contr�b�tions as required by City
Ordinance shall be made prior to recordation of the Final hiap.
21. Developer shall dedicate land as directed by the City Council as
a condition of the Final Map, for park and recreation purposes.

1. A Final Map for subject Tract No. 14004 shall not be approved for
recordation until lot 141 of Tr. No. 14003 is conveyed to the City
of Palm Desert for park and recreation purposes, to satisfy the
Public Facilities requirement of the subject tract.
2. Except for approved private street entrances to the tract, the entire
perimeter shall be bounded by a six (6) foot high masonary wall to
be installed in the first phase, as approved through the Design
Review process.
3. Each phase shall be served by full private street improvements,
and that any phasing shown on the Final bsap shall reflect this
condition.
4. This subdivision shall pay $?,100.00 to the Signalization Fund of
the City of Palm Desert. These funds shall be applicable to a
signal at the intersection of San Pablo Avenue and 44th Avenue.

7.
This subdivision shall pay $1,500.00 into the Drainage Fund of the
City of Palm Desert.
San Pasqual shall be approved with curb, gutter and pavement on the
westerly side thereof.
It is recommended that the street width right-of-way be 38 feet, in
accordance with the Subdivision Ordinance of the City of Palm Desert.
8. The 100-foot drainage easement located on the easterly side of this
subdivision shall be landscaped in accordance with the recommendations
of the Director of Environmental Services.
9. The 100-foot drainage easement shall be sized by the subdivider's
engineer for a trapezoidal ditch and excavated. The soil excavated
therefrom shall be utilized within the tract.

Provide the following f'ire protection in accordance with �he Unit'orm Fire Code:
l. Install a water system capable of deliverit� 2500 GPPJI �ire ilo�v from any fire
h,�drant for a two hour duration in addition to domestic supply. The compuiation
shall be based upon a minimum of 20 psi residual operating pressure in the su�ply
main from w�hich the flow is �easurea at the time of ineasurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a� �ut not greater than 500 feet apart in any direction.
A. Exterior surface of hydrant baz•re�s ana neads shall be painted chrome yellow,
and the tops and nozzle caps sha11 be painted green.
i3. Curbs �nall be painted red 15 feet in either uirection from each hyarant.
3. Prior to recordation of the firial nap, the developer shall furnisn the orioinal
and three (3� copies of t'r�e water system plan to the Fire I�larsnal for review.
4. The v�ater system plan snall oe signed by a reoistered civil er.�ineer ana approved
oy tne water company, with tne follotving certification; "I certi£y that the desigr_
of the v:ater system in rract No, 14004 is in accordance witn �he requirements
prescrieed by the Fire Pclarshal." Upon approval, the origir_�al plan will be
returned to the developer.

5. Prior to delivery of combustible materials to the building site, the required
water system shall be installed, operating and delivering the required flow.
