HomeMy WebLinkAboutCC RES 79-0260 ♦ RESOLUTION N0. 79-26 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVIr1G A TENTATIVE TRACT MAP TO CREATE 157 LOTS ON APPROXIMATELY 40 ACRES, LOCATED SOUTH AND �-JEST OF THE INTERSECTION OF MESA VIEW DRIVE (EXTENDED) AND PORTOLA AVENUE (EXTENDED) IN THE PR-7 ZONE. CASE N0. TT 14082 WHEREAS, the City Council of the City of Palm Desert, California, did on the 22nd day of March, 1979, hold a duly noticed Public Hearing, to consider the request of SILVER SPUR ASSOCIATES for approval of a Tentative Tract Map to create 157 lots providing for 150 residential condominium units on approximately 40 acres within the PR-7 (Planned Residential, max. 7 d.u./ac.) zone located south and west of the intersection of Mesa View Drive (extended) and Portola Avenue (extended), more particularly described as: APN 631-110-010 631-250-038 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject request is a subsequent approval for an on-going project, and no further documentation for purposes of CEQA is deemed necessary; and WhEREAS, the Palm Desert Planning Commission has recommended approval by Resolution No. 467; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of develop- ment proposed. 4. The design of the subdivision and the proposed improve- ments are not likely to cause substantial environmental damage or serious health problems, as conditioned. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: l. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That it does approve the above described Tentative Map No. 14082 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that compliance with Article 26.48 of the City of Palm Desert Subdivision Ordinance is hereby acknowledged through prior agreements with the named subdivider. The development of the property described hereinshall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public�improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. '3. Prior to submittal of the Final hlap, the applicant shall provide � the Department of Environmental Services with a list or proposed street names with at least three alternatives. The approval of the final street name shall be made by the Director of Environ- mental Services. 4. Access rights to hiesa View Drive shall be offered to the City as a dedication on tne Final h?ap. 5. The C.C.B.R's for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: , a. The document to convey title. b. Covenants and restrictions to be recorded. c. b4anagement and maintenance agreement to be entered into with the owners of the units of the project. Improvement plans for water and se�ver system shall meet the re- quirements of the respective service districts. � Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 7. 8. All dedicated land and/or easement's required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of a11 liens and encumbrances. � • �. All on-site utilities, including cable TV, shall be placed under- ground and shall be completely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before _ construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision im- provements by the City. 11. In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flo�vs shall be installed as recommended by the Fire hiarshal. , 12. Prior to recordation of the Final \iap, the developer sh111 furnish the ariginal and three (3) copies of the water system plan to the Fire Itlarshal for review. - - -- -- - - --- - +�13. All requirements of the City Fire ?,Iarshal in letter of February 16,_1979, as amended, shall be met as a Uart of the development of this tract. 14. The w•ater system shall be sibned by a registered civil en�ineer and approved by the water company, �vith the follo«�ina certification: "I certify that the design of the �vater system of Tract No.190S2 is in accordance with the requirements�prescribed by the City Fire �farshal." RESOLUTION N0. 79-26 PAGE FOUR 5. Drainage shall be subject to approval of the City Engineer. Ap- licant shall provide engineered data as requested. 6. All private streets shall be inspected by the Enbineering Depart- ment and a Standard Inspection Fee shall be paid. 7. The total number of lots shall be limited to 150 condominium units, plus other lots for common use and open space. 8. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the Tentative biap for filing of the Final hiap unless an extension of time of up to eighteen (18) ! months is granted by a Resolution of the City Council. 9. Site development shall conform to Design Review Case No, 164 hiF, as approval by Planning Commission Resolution No. 460, and the Final Tract Itfap design shall reflect pertinent conditions. 2. Revise Mesa Vie�v Drive, street section, as directed by the City. 3. Design of the Tentative Tract shall accommodate normal storm water run-off and shall be in accordance with the Master Drainage Plan. The specific design features shall be reviewed and approved by the Director of Public Works. 4. CALIFORNIA 9237� TELEPHONE (7141 657•3t83 Provide the following fire protection in accordance with the Uniform Fire Code: 1. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic supply. The computation shall be based �on a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. � 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: " I certify that the design of the water system in Tract No. 14082 is in accordance with the requirements prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Alternative access must be provided.
