TT 13881 WHEREAS, the City Council of the City of Palm Desert, California, did on the 26th day of April, 1979, hold a duly noticed Public Hearing to consider the request of DAME'-DOTY DEVELOP��ENT COMPANY for approval of a Tentative Tract Map to allow 653 dwelling units and golf course in the PR-5 (Planned Residential, max. 5 d.u./ac zone on approximately 238 acres located on the west side of Portola Avenue and north of the Whitewater Storm Channel, r�ore particularly described as: APN 621-350-016 621-350-017 621-350-018 621-350-020 621-350-023 621-200-020 621-200-032 621-200-033 i.� _, �:� D � ;=...�i.�-.l1.�C-- '� i3Y (;�`'�:�.1; i N:�� � ---� � �-- � Dl1T�J: .......IU.:-.� �_ ' �. =1....-�----------- � WHEREAS, the Planning Cor.unission, by Resolution No. 474, has recommended approval subject to conditions; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Qualit;� Procedure Resolution P1o. 78-32", in that the subject project has been previously assessed under DP O1-79, and no further evaluation is deemed necessary. ) WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of alI persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1 2. 3 The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert P'Iunicipal Code, and the State of California Subdivision T'fap Act, as amended. The subject Tentative Map does comply with the adopted General P1an and the Palm Desert Zoning Ordinance. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT P,ESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and con- stitute the findings of the Council in this case. 2. That it does hereby approve the above described Tentative ?�Iap No. TT 13881 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the requirements of Article 26.48 of the City of Palm Desert RESOLUTION :JO. 79-45 Page two . . Subdivision Ordinance. In return, the City Council hereby agrees to use said fees for park purposes in conformance with an adopted Master Plan, within five (5) years of the recordation of the Final Map. The development of the property described hereinshall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions • of all municipal ordinances and State and Federal statutes no�v in force, or which hereafter may be in force. .2. Full public improvements including traffic safety lighting as re- quired by Ordinance and the City Engineer shall be installed in accordance with City standards. '3. Prior to submittal of the Final blap, the applicant shall p rovide the Department of Environmental Services with a list vr proposed street names with at least three alternatives. The approval of "the final street name shall be made by the Director of Environ- mental Services. '4. Access rights on Portola Ave. (e�ccept for one private street entrance and one ma.inten- �ance/�nergency access) sha11 be offered to the City as a dedica.tion on the Final Map. 5. The C.C.&R's for this development shall be submitted to the City . Engineer for revie�v and approval prior to the issuance of any � building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the City Engineer: � 6. �.7. � a. The document to convey title. � b. Covenants and restrictions to be recorded. . c. hianagement and maintenance agreement to be entered into � with the owners of the units of the project. d. I�ng tezm agreements relating to the ownership of the golf course, Improvement plans for water and sewer system shall meet the re- quirements of the respective service districts. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. � .8. All dedicated land and/or easements required by this approval shall .. be gz•anted to the City of Palm Desert, without cost to the City and • free of all liens and encumbrances. ' . �. All on-site utilities, including cable TV, shall be placed under- oround and shall be completely concealed from vie�v eYcept certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before _ construction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision im- provements by the City. 11. , . .12 . In order to maintain reasonable fire protection during the construc- tion period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants �vith required fire flows shall be installed as recommended by the Fire hiarshal. Prior to recordation of the Final Map, the developer shall furnish the original and three (3) copies of the water system plan to the Fire Marshal for review. _.-_---.... _. ..___. _. 13. All requirements of the City Fire P;Iarshal in letter of blarch 20, 19.Z9, shall be met as a part of the development of this tract. 14. Page four � •--_y '.15. Drainage shall be subject to approval of the City Engineer. Ap- plicant shall provide engineered data as requested. 16. All private streets shall be inspected by the Engineering Depart- { ment and a Standard Inspection Fee shall be paid. i 17. All requirements of the Planning Commission action on the Develop- �� ment Plan 01-79 shall be met as a part of the development of this tract. 1 8. The total ntunber of lots shall be limited to 653 condaniniwn unit lots, plus other lots deemed necessary to define c,orrrnon areas, recreation areas, and private streets. :19. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council.. 20. Draina;e and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final hlap. . 21. Developer shall pay a fee in lieu thereof as a condition of the � Final hiap,.for.park and recreation purposes. Page Five A Final Tract Map for the subject site shall not be approved until the Design Review process has been completed. � 2. The area of this tract within the Whitewater Storm Channel shall be placed in turf and permanently maintained (except for approved impervious surfaces), or provide an adequate alternative protection for Portola as approved by the Director of Public Works. 3. The Portola Avenue street cross section detail shall be revised to reflect an eight (8) foot wide meandering side�aalk, and pedestrian easement shall be granted to the City where the sidewalk meanders out of the public right-of-way. 4. A site boundary wall as required in DP O1-79 and as approved through the Design Review process shall be designated on the Final Map. 5. The subdivider shall make a$1,500 per acre contribution to the City of Pa1m Desert Drainage Fund; approximately 30 acres in the in the Whitewater [Jash to be exempt. 6. Portola Avenue extension and improvements shall be as conditioned in DP O1-79, and it is further noted that the subdivider shall be responsible for 50' half street improvements adjacent to this tract. 7. �; The golf course shall be designed and utilized as a retention basin for drainage control as required and approved by the Director of Public Works. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two hour duration in addition to domestic suoply. The computation sha11 be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. 2. 3. 4. � Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. 6. Curbs shall be painted red 15 feet in either direction from each hydrant. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system pian to the Fire Marshai for review. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the � design of the water system in Tract No. 13881 is in accordance with the require- ments prescribed by the Fire Marshal." Upon approval, the original plan will be returned to the developer. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. Very truly yours, Da ' L.
