A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, FINDING AND DETERMINING
THAT PUBLIC INTEREST AND NECESSITY REQUIRE
ACQUISITION OF PROPERTY AND AUTHORIZING
AN ACTION IN EMINENT DOMAIN
WHEREAS, pursuant to the provisions of California
Government Code Section 37350.5, the City of Palm Desert,
California, possesses the right to acquire property by
eminent domain;
WHEREAS, the property to be authorized to be
taken pursuant to this resolution wi11 be used for the
construction, maintenance and use by the general public
for road right-of-way purposes;
WHEREAS, the real property herein involved is

fully described in Exhibit A attached hereto, which is
hereby incorporated by reference as though set forth in
full at this point;
WHEREAS, written notice has been given to all
owners of record of, and to all other persons ascertained
to have an interest in, the property described in Exhibit
A, giving each of them an opportunity to appear and be
heard, prior to the passage of this resolution;
NOW THEREFORE, the City Council of the City of
Palm Desert, California, hereby FINDS AND DETERMINES the
following:
1. That the public use for which the real property
hereinafter described is to be taken is for the construction,
maintenance and use by the general public for road righ�-
of-way purposes. Section 37350.5 of the Government Code
of the State of California authorizes the City to acquire
the real property hereinafter described for the public
use set forth herein.
2. Such real property to be taken for the public
use is located in Riverside County, State of California
generally located on Monterey Street in the City of Palm
Desert and each parcel to be taken is more particularly

described in Exhibit A attached hereto and made a part
hereof .
3. The City Council of the City of Palm Desert
finds and determines as follows:

(a) The public interest and necessity require
the proposed project described above.
(b) The proposed project is planned and located
in a manner that will be most compatible with the greater
public good and least private injury.
(c) The real property described in this resolution
and the fee title thereto is necessary for the proposed
project.
NOW THEREFORE, based on all of the above, the
City Council of the City of Palm Desert, California does
hereby RESOLVE as follows:
That proceedings in eminent domain be commenced
by the appropriate officers of the City and the attorney
for the City in the Superior Court of the State of California
for the County of Riverside for the acquisition of fee
title of the parcels of real property described in Exhibit
A attached hereto for the public use and purposes recited
herein to take immediate possession hereof when appropriate.
PASSED, APPROVED AND ADOPTED by the City Council
this 28th day of June , 1979, by the following
vote:

in the office of the County Recorder of said County. Said
property is also situated in the City of Palm Desert.
PARCEL 6: Lot 313 in PALMA VILLAGE UNIT NO.

in the office of the County Recorder of said County. Said
property is also situated in the City of Palm Desert.
