A RESOLUTION OF Tf-iE CITY COUNCIL OF TI-IE CITY OF PALM
DFSERT, CALIFOFd�1IA, NIP,ICING APPLICATION TO TI-� L�OCAL
AGQ�ICY FORMATION CONiN1ISSION FOR A CHANGE OF ORGANIZA-
TION KNOWIJ AS, "PAI.M DESERT �1I�iEXATION NO. 10", PURSUANP
TO SDCTION 35140 OF 'II-IE STATE GOVEHIVMINI' CODE.
Wf-IEREA.S, one hundred percent of the property cx�mers have
requested, by petition, withiri the area hereafter known as, "Palm
Desert Annexation No. 10," and more particularly described in the
attached map and legal description; and
WI�REAS, the California E�vironmental Quality Act has been
canplied with, pursuant to City Council Resolution No. 78-32, in that
all responsible agencies have been contacted and a Negative Declara-
tion has been prepared in conjunction with preannexation zoning con-
siderations; and,
Wf-IEREAS, the City Council has determined that the proposed
change of organization is appropriated for the following reasons:
1. The request is a logical expansion of the City bound-
aries.
2. The proposed annexation is consistent with the Muni-
cipal Organization Act of 1977 which encourages limiting
the rnm�ber of annexations to those areas considered
logical grawth areas.
3. The proposed area to be annexed is of satisfactory size
to provide municipal services without adversely affecting
the rest of the corrmunity.
NOW, TI-�REFORE, BE IT RESOLVID by the City Council of the
. City of Palm Desert, California, as follaws:
1. The above recitations are hereby determined to be true
and correct and represent the findings of the Council
in this matter.
2. The City Clerk is hereby instructed to file an official
application with the L�ocal Agency Formation CorrrYussion
for Palm Desert Annexation No. 10, pursuant to the Muni-
cipal Organization Act of 1977 for uninhabited territory
since less than twelve registered voters reside in the area.
PASSED, APPROVED and ADOP`!`ED at a regular meeting of the
Palm Desert City Council, held on this 28th day of June, 1979, by the
following vote, to wit:

ANNE}CATION DESCRIPTION
Beginning at a point in the easterly boundary line of the City of
Palm Desert, County of Riverside, State of California, said point
being the co�n section corner of Sections 9 and 10 and Sections
15 and 16, 'Ibwnship 5 South, Range 6 East, San Bernardino Base and
Meridian.
Thence, South 89° 47' 20" h'est along the section l�ne of the afore-
mentioned Sections 15 and 16, a distance of 1,327.05 feet to the
true point of beginning.
(1) Thence, South 00° 06' 28" West a distance of 1,326 feet;
(2) Thence, South 89° 49' O1" West a distance of 1,320 feet;
(3) Thence, North 00° 06' 28" East a distance of 1,326 feet;
- (4) Thence, along the ccrrrnon section line of Sections 9 and 16
to the true point of beginning.
This parcel contains 39.77 acres more or less.

SUBJECT: Plan for Services for Palm Desert Annexation No. 10
I . INT%JDL3CTION :
Pursuant to Section 35102 of the State GavernmP.nt Code, the City is
required to file with any new Annexations effective January 1, 1978,
a plan outlining the method by which services will be provided in
the area to be annexed. 'I'his report represents the required plan
for services for Proposed Annexation No. 10. The City of Palm Desert,
being a contract City, must rely on many other agencies to provide
for se.rvices both in the canrnuLity and areas subsequently annexed.
In addition, many services provided such as water and sewer, elec-
tricity, gas, are provided without regard to city limit lines. There-
fore, the area proposed to be annexed is presently served or has the
capability of being served by many of these agencies. The fact is
substantial by the letters received fran responsible agencies as a
part of the Environmental Review process, and in conjunction with
preannexation zoning considerations.
The major emphasis of this report is to address those services pro-
vided directly by the City either through City Staff or direct con-
tract with the City by other agencies. In addition, wherever possible,
this report will address the methods by which other service agencies
would provide needed facilities in the area.
II. DFSCRIPTION OF SERVIC,ES:

The utilitites which wr�uld be extended into the area proposed to be '
annexed wr�uld be as part of actual development and they would consist
of the services of the Coachella Valley County Water District in the
area of water and se�w�er, Southern California Edison Ca�ny in the
area of electricity, Southern California Gas Car�any in the.area of
gas, and Able Cable in the area of cable television. The seivices
provided by this City directly w�uld be in planning and building,
public works, parks, administration and code enforceqnent sexvices.
By contract the City would also provide for trash disposal, police
and fire services. Public transportation w�uld be provided by the
Sunline Agency.
The major road irrq�roveznents would include the extension and improve-
ment of 42nd Avenue, which wr�uld border the site on the North.
Rebecca Road w�uld be provided with a cul-de-sac at its present
northerly extension, which is just north of Merle Drive. The creation
of any local streets w�uld be on the basis of specific projects and
would be the responsibility of the developer.
Ultim�ate developme.nt of the subject annexation and adjacent properties
will necessitate a bridge crossing at the Cook Street crossing of
the Whitewater Storniwater Channel. This facility would be constructed
with a car�ination of federal grants and local participation very
similar to existing bridges in the Valley.
Public park needs in the area to be annexed will partially be ful-
filled by on-site recreational arnenities. Residents will also be
able to take advantage of the proposed 120-acre Sand Dune Park to
the north of the subject area.
I I I. L�IEL AND RANC� OF SERVICES :
The level and range of services provided wr�uld include sufficient
sized water and sewer, gas, and electrical facilities to service
developmexlt proposed for the area. Planning and building, public
wc�rks, and code enforc�nent services as provided by the City directly,
would be on the basis of need. Police and fire sexvices capability
exist to meet the need of the area at its present stage of develop-
ment and are proposed to be expanded to meet the needs of subsequent
development in the area. Public transportation would be provided by
the expansion of the existing systen to serve the area. Subsequent
develo�zt will result in the need for the City to add an additional
police vehicle and the need for an additional fire station in the
vicinity of Country Club Drive.
Since fire services are provided on a volunteer basis in a�njunction
with the County of Riverside and State Department of Forestry, the
City wnuld be re�u.ired to provide for a facility in the area which
wr�uld be manned by these agencies. A fire station has been planned
for in the City's Genexal Plan in this area and will be provided at
the time it is needed. In addition, said area will be served by a
proposed fire station at 44th Avenue and San Pablo (Civic Center
Ccx►�lex), which is tentatively proposed for construction in 1980/91
budget year. In the meant�me, the area would be served by the ea�isting
Palm Desert Station at E1 Paseo and Highway 74 with backup being
provided by the Rancho Mirage, Thousand Pa]ms and Bermuda Dunes sta-
tions. The basic ac�ninistration services of Planning, Building, Pub-
lic Works, and Code enforc�ne,nt w�uld be provided by existing City
Staf f .
N. TIMING FOR SERVIC� EX'I�TSIONS:
Basic utility services w�uld occur as a part of development. The
City has on file letters frccn the various utilities assuring us that
these services would be available. The City services w�uld be avail-
able imnediately in the area of planning, building and code enforce-
ment, public works, and police and fire. Road improvenents wvuld
occur as a part of new developm�nt. The construction of the new fire
station near Country Club Drive wr�uld result from the City's new con-
struction tax which would be accrued fram the new developmPxit in the
area, which would be $250.00 per trailer space. Parks wnuld be
developed in the area under the City's Subdivision Ordinance which
provides for the dedication of land andjor payment of fee for ccan-
munity facilities and would provide for sites for the fire station
and parks.
The proposed residential development cont�lated for the area is a
m�bile hane park, which would include a majority of necessary recrea-
tional facilities to sexve the ultimate residents of the area.
V. RDQUIRF,METirS OF NEW DEVF.L,OPME:NT AND FINANCING:
New developme�zt would be requixed to extend roads around the area
and to provide for needed sites for fire, parks and other related
municipal facilities provided through the City's Subdivision Ordinance.
The new Construction Tax of $250.00 per trailer space w�uld provide
for construction and additional acquisition of these facilities. The
provision of planning and building services would be provided through
the fees generated frcan n�w developirnnt. On-going maintenance of
roads, created in the area, w�uld be provided through State Gas Taxes
generated as a result of population within the area. Police services
and parks maintenance �uld be provided on the basis of Sales Tax
generated frcan c.�onmercial facilities in the area. In sLunnary, it is
felt that development of this area w�uld result i.n a balance between
needed services and the revenues to provide said services.
