HomeMy WebLinkAboutCC RES 79-094CITY COUNCIL RESOLUTION N0. 79-94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DENYING THE APPEAL AND UPHOLDING THE FINDINGS OF THE CITY PLANNING COMMISSION AS SPECIFIED IN PLANNING COMMISSION CASE N0. VAR 04-79 1. The Planning Commission findings were correct in that the applicant has not shown that a"hardship" exists and that the proposed signing is necessary for identification or directional purposes. 2. The approved freestanding sign provides adequate identificaiion for the single tenant and is designed to be compatible with the building it identifies. 1. That the above recitations are true and correct and constitute the findings of the Council in this matter; WHEREAS, the City Planning Commission did consider VAR 04-79 to allow additional signs for RB Furniture on the west side of Highway 111 at the common City limit boundary between Palm Desert and Rancho Mirage, as filed for by Heath and Co., and, WHEREAS, the Planning Commission did after the completion of the Public Hearing on this matter conclude by Resolution No. 504 that two additional wall signs oriented to the street frontage and rear parking area were not warranted; and, WHEREAS, the applicant has filed a timely appeal of the Commission's decision; and, WHEREAS, after a duly noticed Public Hearing held on August 9, 1979, at which the City Council did consider all testimony and arguments, the City Council did find that the following facts and reasons do exist to justify the denial of the appeal and the upholding of the findings of the Planning Commission: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 2. That the applicant's appeal of the Planning Commission decision on Case No. VAR 04-79 is hereby denied and the findings of the Planning Commission as specified in Planning Commission Resolution No. 504 are hereby upheld. , PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 9 th day of Au�, 1979, by the following vote, to wit: _ AYES: Brush, Newbrander, Wilson NOES: None ABSENT: Mullins / ABSTAIN: None � EDWARD D.
