HomeMy WebLinkAboutCC RES 79-099CITY COUNCIL RESOLUTION N0. 79-99 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW THE CREATION OF FIVE SINGLE- FAMILY RESIDENTIAL LOTS. CASE N0. TT 14645 WHEREAS, the City Council of the City of Palm Desert, California, did on the 23rd day of August, 1979, hold a duly noticed Public Hearing to consider the request of RODNEY J. BARTOW for approval of a Tentative Tract Map to create five single-family residential lots on approximately 1.25 acres within the R-1 10,000 (Single-Family Residential, min. 10,000 sq. ft. lot size) zone generally located on the south side of Homestead Road, between Beverly Drive and Highway 74, more particularly described as: APN 631-040-004 APN 631-040-006 APN 631-040-007 APN 631-040-009 WHEREAS, the Planning Commission, by Resolution No. 516, has recommended approval subject to conditions; and WHEREAS, said application has complied with the requirements of the " ity of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has not been found to present an adverse impact on the environment and a Negative Declaration has been prepared. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract Map: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of development proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Commission in this case; 2. That it does hereby approve the above described Tentative Map No. TT 14645 for the reasons set forth in this Resolution and subject to the attached conditions. FURTHER, BE IT RESOLVED that the recommended conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City Council hereby agrees to use said fees for park purposes in conformance with an adopted master plan, within five (5) years of the recordation of the final map. Orainage and Signalization Fund contributions as required by Cit� Ordinance shall be made prior to recordation of the Final Map. 18. Developer shall pay in-lieu fees for park and recreation purposes to compl/ with the requirements of Article 26.48 of the City of Palm Desert Subdivision Ordinance. SPECIAL CONDITIONS OF APPROVAL CASE N0. TENTATIVE TRACT N0. 14645 1. Complete half street improvements, as required by the Director of Public Works, shall be installed along Homestead Road; including curb and gutter, and tie-in paving. 2. Subdivider shall contribute $250 into the Cit� of Palm Desert Signalization Fund. 3. If Tract is to be graded prior to all building permits being issued, a program for soil stabilization shall be submitted to and approved by the Director of Environmental Services. 4. If, after City Staff research, it is determined that the access easement illustrated along the east boundary of the Tract is under public control, subdivider shall install curb and street impro��ements as required by the Director of Public Works. r � CITY COUNCIL RESOLUTION N0. 79-99 STA�JDARD COf`JDITIOi1S OF APPRO`!AL CASE N0. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes no�•� in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal of the Final Map, the applicant shall provide the Department of Environmental Services with a list of proposed street nar�es with at least three alternatives. The approval of the final street name shall be made by the Director of Environmental Services. 4. The C.C&R.'s for this development shall be submitted to the City Engineer for review and approval prior to the issuance of any building permits. Prior to recordation of the firal subdivision map, the applicant shall submit to th� City Engineer: " a. The docur�ent to convey title. b. Covenants and restrictions to be recorded. 5. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 6. Area shall be annexed to appropriate Improvernent Districts having jurisdiction over the subject area. 7. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 8. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from vie�r� except certain appurtenances as may be approved by the Director of Environnental Services. 9. Complete plans and specifications shall be submitted as requir2d by Ordinar�ce io the City Engineer for checking and appreval before construc�ion of an� improvements is cemmenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision improvements by the Cit�. 10. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. An adequate number of fire hydrants with required fire flo�•�s shall be installed as recomrnended by the Fire t�arshal. 11. Prior to recordation of the Final Map, the d2veloper shall furnish the original and three (3) copies of the water system plan to the Fire htarshall for re��ie:�. �12. Drainage shall be subject to approval of the City Ergineer. Applicant shall provide engineered data as requested. 15. The total number of lots shall be limited to fi��e. 16. The applicant shall have tti•,elve (12; months from the date of the approval or con- ditional approval of the tentative r�ap for filing of the final map unless an extention of time of up to eighteen (18) months is granted by a Resolution of the City Council. Install a water system capable of delivering 1500 GP�1 fire flow from any fire hydrant for a t�•�o r�our duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pr�ssure in the supply ma�n from which the flo�•� is measured at the time of ineasurement. 2. Install Riverside County super fire hydrants located at each street intersection (a) but not greater than 500 feet apart in any direction. A. Exterior surface of hydrant barrels and heads shall be painted chrome yelloti��, and the tops and nozzle caps shall be qainted green. B. Curbs shall be painted red 15 feet in either direction from each hydrant. 3. Prior to recordation of the final map, the developer shall furnish the original anc; three (3) copies of the ti•�ater systen plan to the Fire f�arshal for revie�.�. 4. The water system plan snall be signed by a registered civil engineer and aporo�i2� by the water company, with the `ollo�•�inq certirication: "I certif,� that the �esicn of the water system in Tract No. 14.645 is in accor�ance �•�ith the requirer�ents prescribed by the Fire ��arshal." Upon approval, the original plan ��ill be returned to the developer. 5.
