HomeMy WebLinkAboutCC RES 80-123RESOLUTION N0. 80-123 A RESOLUTION OF THE CITY COUNCIL QF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A ONE YEAR TIME EXTENSION PURSUANT TO THE PROVISIONS OF SECTIOPJ 26.20.140 OF THE PALM DESERT MUNICIPAL CODE OF THE APPROVED TEP�ITATIVE TRACT MAP. CASE N0. TT 14996 WHEREAS, the City Councii of the City of Palm Qesert, California, did - receive a request from MACK DEVELOPMENT, INC., for a one year time extension, pursuant to the provisions of Section 26.20.140 of the Palm Desert Municipal Code of the approved Tentative Tract Map TT 14996 to create a 118 lot subdivision for condominium purposes on property located on the south side of Country Club Drive, approximately 1800 feet east of Monterey Avenue, more particularly described as: APN 621-190-005, 006 and 007 WHEREAS, the City Council is empowered to grant time extensions of up to eighteen months for filing of the final map in Section 26.20.140 of the Palm Desert Municipal Code; and, WHEREAS, the City Council did find the following reasons to exist to justify the granting of said time extensions: 1. Granting the time extension will not in any way adversely affect the public health, safety or general welfare. 2. The applicant is not proposing any changes to the project and the situation in the vicinity of the project is unchanged since the Tentative Tract was originally approved. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Palm Desert, California, as follows: 1. That MACK DEVELOPMENT, INC., is hereby granted a one year extension of the approval of Tentative Tract Map, TT 14996, subject to all conditions of Resolution No. 79-112, amending Special Condition No. 4 as follows: "Subdivider shall pay $5,800 into the Signalization Fund, and $3,700 per gross acre into the Drainage Fund of the City of Palm Desert"; and, Add Special Condition No. 9: "The developer shall grant required easements and participate in and/or construct the storm drain facilities according to the Master Storm Drain Plan of the City of Palm Desert along Hovley Lane and retain approximately a ten-year storm intensity on site." 2. That the final map for Tract 14996 must be filed prior to September 28, 1981. PASSED, APPROVED and ADOPTED by the City Council of the City of Palm Desert, California, on this 25th day of September, 1980, by the following vote, to wit: AYES: NOES: ABSENT: ABSTAIN: McPherson, Newbrander, Puluqi, Snyder & Wilson None None None ATTEST: �� � '� � .
