HomeMy WebLinkAboutCC RES 80-130RESOLUTION N0. 80-130 A RESOLUTION OF THE CITY COUPJCIL OF PALP-1 DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING AN APPEAL OF A PLANNING COMP1ISSION APPROVAL OF A VARIANCE FRQM THE REQUIREMENTS OF THE PALM DESERT MUNICIPAL CODE REGARDING THE NUMBER AND LOCATIOPd OF IQENTIFICATION SIGNS IN COMMERCIAL AND INDUSTRIAL ZONES. CASE N0. VAR 06-80 WHEREAS, the City Council of the City of Palm Desert, California, did on October 23, 1980, hold a duly noticed Public Hearing to consider an appeal of the approval granted to QRS CORPORATION (for ANAHEIM SAVINGS) for a Variance from the Palm Desert Municipal Code (Sign Ordinance} to allow two (2) main signs, one of which would be a freestanding sign located within the C-1, S.P. (General Commercial, Scenic Preservation Overlay) zone, generally located at the northwest corner of El Paseo and San Pablo Avenue, more particularly described as: APN 627-202-003 WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, the City Council did find the following facts and reasons to exist to justify the approval of said appeal: 1. The strict or literal interpretation and enforcement of the adopted Sign Ordinance will not result in practical difficulty or unnecessary physical hardship inconsistent with the objectives of the ordinance. 2. There are no recognizable exceptional or extraordinary circumstances or conditions involved that do not generally apply to other commercial buildings with similar orientations. 3. The Sign Ordinance provides for signing beyond the main identifica- tion sign; therefore, the strict or literal interpretation and enforcement of the Ordinance would not deny the applicant a privi- lege enjoyed by others in a similar circumstance. 4. The action of the Planning Commission was not appropriate for the above reasons. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case; 2. That the appeal of the Planning Commission action is approved and therefo��e, Case No. VAR 06-80 is hereby denied.
