HomeMy WebLinkAboutCC RES 80-023RESOLUTION N0. 80-23 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW A 20 UNIT CONDOMINIUM PROJECT LOCATED ON THE SOUTH SIDE OF HOVLEY, 2440 FEET EAST OF MONTEREY AVENUE. CASE N0. TT 14997 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of February, 1980, hold a duly noticed Public Hearing �- to consider the request of PRO-CON DEVELOPMENT/T & D INVESTMENTS to subdivide land into 24 lots to allow 20 condominium units, recreational area, and common open space on approximately �.5 acres within the PR-5 (Planned Residen- tial, 5 d.u./ac.) zone generally located on the south side of Hovley Lane, 2400 feet east of Monterey Avenue, more particularly described as: APN 621-190-071 APN 621-190-080 WHEREAS, the-Planning Commission, by Resolution-No. 570, has -- recommended approval, subject to conditions; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Environmental Quality Procedure Resolution No. 78-32", in that the subject project has been previously assessed under DP 09-79 (A), and no further evaluation is deemed necessary; and WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons to exist to recommend approval of the Tentative Tract P1ap: 1. The subject Tentative Map does substantially comply with Chapter 26 of the City of Palm Desert Municipal Code, and the State of California Subdivision Map Act, as amended. 2. The subject Tentative Map does comply with the adopted General Plan and the Palm Desert Zoning Ordinance. 3. The site is physically suitable for the type of develop- ment proposed. 4. The design of the subdivision and the proposed improvements are not likely to cause substantial environmental damage or serious health problems. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pa1m Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the above described Tentative Map No. TT 14997 for the reasons set forth in this Resolu- tion and subject to the attached conditions. FURTHER, BE IT RESOLVED that the conditions of approval do include a requirement that the applicant pay in-lieu fees to comply with the require- ments of Article 26.48 of the City of Palm Desert Subdivision Ordinance. In return, the City Council agrees to use said fees for park purposes in con- formance with an adopted master plan, within five (5) years of the recordation of the final map. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Full public improvements including traffic safety lighting as required by ordinance and the City Engineer shall be installed in accordance with City standards. 3. Prior to submittal the Department of street names with final street name Services. of the Finai Map, the applicant shall provide Environmental Services with a list of proposed at least three alternatives. Access rights to Hovley Lane (except for one approved project entranc�- and utility access easement) shall be offered to the City as a dedica- tion on the Final Map. 5. The C.C. & R's for this development shall be submitted to the Director of Environmental Services for review and final approval by the City Attorney prior to the issuance of any building permits. Prior to re- cordation of the final subdivision map, the applicant shall submit to the City Engineer: a. The document to convey title. b. Covenants and restrictions to be recorded (Which have been approved). c. Management and maintenance agreement to be entered into with the owners of the units of the project (Which has been approved). 6. Improvement plans for water and sewer systems shall meet the require- ments of the respective service districts. 7. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject area. 8. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 9. All on-site utilities, including cable TV, shall be placed underground and shall be compleiely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. 10. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before con- struction of any improvements is commenced. The subdivider shall submit "as-built" plans prior to acceptance of the subdivision - improvements by the City. 11. In order to maintain reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings. As adequate number of fire hydrants with required fire flows shall be installed as recommended by the Fire Marshal. 12. Prior to recordation of the Final Map, the developer shall furnish the orignal and three (3) copies of the water system plan to the Fire Marshal for review. 13. All requirements of the City Fire Marshall from his letter of June 6, 1979, (attached to Planning Commission Resolution No. 506, DP 09-79) shall be met as a part of the development of this tract. 14. The water system shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system of Tract No. 14997 is in accordance with the requirements prescribed by the City Fire Marshal." RESOLUTION N0. 80-2" Page -4- � 15. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. 16. All private streets shall be inspected by the Engineering Department and a Standard Inspection Fee shall be paid. 17. All requirements of the Planning Commission action on the DP 09-79 (A) shall be met as a part of the development of this tract. 18. The total number of lots shall be limited to twenty (20) for dwelling unit purposes, and other lots for common use as deemed appropriate. 19. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) months is granted by a Resolution of the City Council. 20. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the Final Map. 21. Developer shall pay a fee in-lieu thereof, as a condition of the final map, for park and recreation purposes. The City shall conunit the use of any such fees received within a five year period. SPECIAL CONDITIONS 1. Subdivider shall contribute an amount equal to $1,000 as a fee paid into the Signalization Fund of the City of Palm Desert. —--- 2. Subdivider shall dedicate and improve Hovley Lane as required to implement the revised design for the adjacent street section, and install drainage system improvements called for in the Master Drainage Plan as required and approved by the Director of Public Works. 3. Subdivider shall install Safety Street Lighting at the intersection of Hovley Lane and the project entrance as required by the Director of Public Works and approved through the Design Review process. :� 5. [� If project entrance is to be secured, the entrance design shall provide for four (4) standing vehicles stacked outside of the public right-of-way. The entire Tract shall be bounded by a minimum 6 foot high solid masonry wall (except for approved openings). The north-south interior private street shall be increased to 32 feet in width, with the radius of the southern turn around area increased to a minimum of 35 feet. 7. The map shall provide for a minimum 30 foot wide common ownership area along the north and west property lines, with adjacent private dwelling unit lot lines and improvements being adjusted accordingly. 8. A revised Tentative Map exhibit shall be submitted to the Director of Environmental Services conforming to all conditions of approval for the Deve1opment Plan and this Tentative Map, and further providing for any site plan changes required through the Design Review process, prior to the filing of a Final Tract Map. AGREEMENT I accept and agree, prior to use of this permit or approval, to comply with all the conditions set forth, and understand that the Department of Building and Safety will not issue a building permit or allow occupancy on the use permitted until this signed confirmation has been received by the Department of Environmental Services. 1 I � Date Applicant's Signature
