HomeMy WebLinkAboutCC RES 80-033� RESOLUTION N0. 80-33 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ANNOUNCING FINDINGS AND APPROVING A ONE YEAR TIME EXTENSION PURSUANT TO THE PROVISIONS OF SECTIONS 26.20.140 OF THE PALM DESERT MUNICIPAL CODE OF THE APPROVED TENTATIVE TRACT MAP TT 14081. WHEREAS, the City Council of the City of Palm Desert, California, did receive a request from DAVID MOSS for a one year time extension pursuant of Section 26.20.140 of the Palm Desert Municipal Code of the approved Tentative Tract Map TT 14081, providing for 28 lots for 24 condo- minium units on approximately 5 acres located on the south side of Hovley Lane, approximately 1650 feet east of Monterey Avenue, more particularly described as: APN 621-190-073 WHEREAS, the City Council is empowered to grant time extensions of up to eighteen months for filing of the final map in Section 26.20.140 of the Palm Desert Municipal Code; and WHEREAS, the City Council did find the following reasons to exist to justify the granting of said time extension: 1. Granting the time extension will not in any way adversely affect the public health, safety or general welfare. 2. The applicant is not proposing any changes to the project and the situation in the vicinity of the project is unchanged since the subject tentative tract was originally approved. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Palm Desert, California, as follows: 1. That DAVID MOSS is hereby granted a one year time extension of the approval of Tentative Tract Map 14081. 2. That the final map for Tract No. 14081 must be filed prior to March 22, 1981, to preserve the validity of said tract. 3. That aporoval of this time extension is subject to all conditions of City Council Resolution No. 79-25, amend- ing the following conditions: Special Conditions: 1. A Final Tract Map for the subject property shall not be recorded until the Design Review process has been completed, fixing the location of dwelling units and other development features in conformance with the approved Development Plan; with map submitted to the Director of Environmental Services for a determination of compliance. 7. This subdivision shall be required to contribute $3,700 per gross acre to the Drainage Fund of the City of Palm Desert. This subdivision shall pay for the installation of the storm drain on Hovley Lane that afronts this pro- perty, with storm drain fees applied to cost of storm drain work; and, �;�dding the following Special Condition No. 11: 11. This tract shall retain an approximate ten year st�rm intensity on-site.
