HomeMy WebLinkAboutCC RES 80-042RESOLUTIO�J N0. 80-42 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, VACATING A PORTION OF STREET IN SAID CITY UNDER THE PROVISIONS OF PART 3, DIVISION 9, OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA. WHEREAS, the City Council initiated proceedings to vacate a portion of a street in the City of Palm Desert, as more particularly described in Exhibit "A" attached hereto, and the City Council finds that said notices of such vacation were published and posted as required by law; and, WHEREAS, the City Council on the 27th day of March, 1980, held a public hearing as required by law, at which hearing all persons interested in or objecting to the pr�aposed vacation were heard, and said public hearing was duly and regularly closed; and, WHEREAS, the City Council of the City of Palm Desert considered such matter and finds from the evidence submitted that portions of the street described in Exhibit "A" are unnecessary for present or prospective public purposes. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE as follows: I That the following described portion of unused street at the north- west corner of Shadow Mountain Drive and Highway 74, in the City of Palm Desert be vacated subject to and retaining all public utility easements existing under said public right-of-way. Said portion of street to be vacated is located in the City of Palm Desert, County of Riverside, State of California, and is described as set forth in Exhibit "A" attached hereto. II The City Clerk of the City of Palm Desert, California, shall cause a certiried copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California. Beginning at the northeast corner of Lot 1 of Palm Desert Unit No. 6 as per map recorded in Book 24, Pages 28 and 29 of Maps, Riverside Records, said point being the true point of beginning. Thence S. 71° 51' 05" E. 28.00' to a point. Thence S. 18° 08' 55" W. 133.78' to a point. Thence 51.23' along a radius curve of 480.00' through a 6° 06' 54" angle concave northwesterly to a point tangent to a 20.00' radius curve. Thence 28.00' along said radius curve through an 82� 30' 21" angle concave northwesterly to a point tangent to the easterly line of said Lot 1. Thence northeasterly along the easterly line of said Lot 1 to the true point of beginning.
