HomeMy WebLinkAboutCC RES 80-054RESOLUTION N0. 80-54 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, AUTHORIZING LEGAL EXPENSES FQR PARTICIPATION WITH THE CITIES OF INDIAN WELLS AND R.ANCHO MIRAGE AND WITH THE COUNTY OF RIVERSIDE IN THE MATTER OF THE NAEGELE BILLBOARDS ON BOB HOPE DRIVE. - WHEREAS, the Cities of Palm Desert, Indian Wells, and Rancho Mirage and the County of Riverside have undertaken litigation in an effort to remove objectionable billboards erected by Naegele Outdoor Advertising Company on Bob Hope Drive; and WHEREAS, it appears necessary to pursue said matter through a series of legal jurisdictions, perhaps a11 the way to the Supreme Court of the United States; and WHEREAS, it is appropria�e that the various public jurisdictions who are plaintiffs in the action be in control of and set limitations on the legal expenses to be incurred. NOW, THEREFORE, BE IT RESOLVED that, effective with the date of this resolution, the City of Palm Desert authorizes legal expenses toward the pursuit of said litigatian not to exceed $10,000, this over and above what has already been expended to the date of this resalution. BE IT FURTHER RESOLVED that the authorization provided herein be subject to the following conditions and limitations: l. The authorization applies only if the Cities of Indian [�ells and Rancho Mirage agree likewise. 2. In the event that fines are collected from any of the defendants in the case, said fines are to be shared by the three cities and the County of Riverside in accordance wi�h a formula based on each jurisdiction's share of legal expenses to the date that the fines are collected. 3. That the County of Riverside will enter inta a formal written agreement with the three cities pledging continuance of the legal action by the County even if and after legal expense contributions authorized herein and by the o�her two cities have been exhausted. Said agreement on the part of the County shall include pursuit of the legal action all the way to the United States Supreme Court should that be necessary.
