Z�J�iEREAS, on the 14th day of August, 1975, the City of Palm Desert, California, and Palm Desert Disposal Services, Inc., entered into an AGR�EP�'IENT TO PERFORi P.EFUSE COLLECTION SERVICFS; and �•1HEREAS, Palm Desert Disposal Services, Inc., has petitioned the City for a change in Schedule "A", the Refuse F,ate Schedule, of said A�reement; and WIiEREAS, Schedule "A" has been previously amended by Resolution No. 78-111 dated September 28, 1978. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert that effective June 3�1, 1980, Resolution No. 78-111 is hereby rescinded; and BE IT FURTHER RESOLVED, that effe�tive July l, 1980, Schedule "A" of said A�reer.ient is hereby amended to reflect the followin�: 1. Individual P.esidential Can Char�es 2. Wa1k-in Service Note: Walk-in service shall not exceed 60 feet from curb. There shall be an additional charge for distance beyond 60 feet as follows: For each additional 20 feet or part thereof, a charge of 60� per unit of 20-fooC distance will be charged. Bulky Household Items Eulky household items that, because of their size or weight (such as furniture, T.V.'s, appliances, etc.) cannot be collected on regular routes,shall be collected based on the Special Haul rate. - 2 - Resolution No. 80-76 Pa�e three 7. Start Fees $3.00 to open a new account or reopen a previous account, or resume service on an inactive waste disposal account, or to transfer an account into a new name. This will be eliminated upon creation of P4andatory Service. B. Unusual Conditions For collections requiring special equipMent or otherwise not set forth in this Agreement, rates may be charged as shall be agreed upon by the Contractor and the customer. � BE IT FUP�THER RESOLVED that a surcharge is hereby continued, to cover the County of Riverside Waste Disposal gate fee; and 1. That Palm Desert Disposal shall notify their customers that the "Surcharge" is added to the basic service rate. 2. That such a surchar�e has been in effect since October l, 197£ 3. That Palm Desert Disposal shall cause to be prepared by an independent audi� firm within 60 days after rlarch 31, 1979, and every year thereafter, a financial statement clearly indicating the fees paid to the County o.f Riverside pursuant to the waste disposal gate fee program and the increased revenue received as a result of imposing the surcharge. 4. That the surcharge be ad.justed a�ter the aud�t report �s furnished to the City according to the amount of revenue generated as compared to the actual cost of disposal plus 10�o for an administrative overhead allowance. Any audit- identified surplus shall be used as a credit for the ensuing fiscal year surcharge revenue account. The City �anaaer is hereby authorized to negotiate a�air surcharge based on the information provided. 5. That the City of Palm Desert shall not include revenue received from the surcharge in gross receipt subject to franchise fees.
