A RESOLUTIOPJ OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT CALIFORNIA DENYING AN APPEAL OF CERTAIN
CONDITIONS IMPOSED ON THE GRANTING OF A CONDITIONAL
USE PERMIT AND AFFIRMING THE CONDITIONS IMPOSED BY
THE PLANNING CO(�1MISSION.
CASE N0. CllP 09-80
WHEREAS, the City Council of the City of Palm Desert, California,
did on the 22nd day of October, 1981, hold a duly noticed Public Hearing to
consider an appeal by PALM DESERT MOBILE ESTATES of certain conditions imposed
on the granting of a Conditional Use Permit by the City of Palm Desert Planning
Commission.
WHEREAS, the Planning Commission, by Resolution No. 742, has approved
the request subject to conditions; and

WHEREAS, said applicant did file a timely appeal to the Planning
Commission action requesting the City Council to delete two (2) conditions; and

WHEREAS, the City Council did at the said Public Hearing find the
following facts and reasons to justify the affirmation of the conditions imposed
by the Planning Commission:

1. The policy of the City with respect to requiring street improve-
ments and dedication has been applied consistently and to waive
the requirement in this instance would be setting a very undesirable
precedent for future developments in the City.
2. Deletion of Condition #19 contained in Planning Commission
Resolution No. 742, relating to a requirement of Coachella Valley
Water District would not result in the condition not being
required if appropriate, because that agency has jurisdiction in
this matter.
3. The City Council with regard to the above item does not feel
it would be appropriate to preempt, alter, delete or affect in
any way the requirements of outside agencies.
IJOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Palm Desert, as follows:
l. That the above recitations are true and correct and constitute
the findings of the Council in this case.
2. That it does hereby deny the said appeal submitted by Palm Desert
Mobile Estates, for the reasons set forth in this Reso1ution, and
hereby affirm the decision of the Planning Commission and the
conditions imposed in its Resolution No. 742.
3. That condition No. 20 is hereby added to Planning Commission
Resolution No. 742 as follows: The site shall be annexed to
Improvement Districts Nos. 54 and 80 of Coachella Valley Water
District for sanitation service.
