HomeMy WebLinkAboutCC RES 81-019RESOLUTION N0. 81-19 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW A ONE LOT SUBDIVISION LOCATED ON THE NORTH SIDE OF RUTLEDGE WAY, WEST OF PORTOLA AUENUE. CASE N0. TT 17104 WHEREAS, the City Council of the City of Palm Desert, California, did on the 3rd day of February, 1981, hold a duly noticed Public Hearing to consider the request of LEWIS HOMES OF CALIFORNIA for approval of a Tentative Tract Map, to aTlow the subdivision of 31 existing duplex lots into a one lot subdivision consisting of 16 phases (62 units) on 9.8 acres within the R-2 (5), S.P. (Single Family Residential, one unit per 5,000 sq. ft. of lot area, Scenic Preservation Overlay) zone generally located on the north side of Rutledge Way, west of Portola Avenue, more particularly described as: Tract 12181-1 WHEREAS, the Planning Commission, by Resolution No. 671, has recammended approval subject to conditions. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89", in that the Director of Environmental Services has determined that ihe project has previously been assessed in connection with Case� No. TT 12181-1 and no further documentation is deemed necessary. , ' (�; WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, sai`d City Council did find the following facts and reasons to exist to approve the Ten�ative� Tract f�ap: (a) That the proposed map is consistent with appli- cable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f) That the design of improvements is not health problems. the subdivision or the type of likely to cause serious public (g) That the design of the subdivision or the type of improvements will not conflict with easements, ac- quired by the public at large, for access through or use of, property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of RESOLUTIOfd fJO. 81-19 Page T4�o Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the above described Tentative Map fdo. TT 17104 for the reasons set forth in this Resolu- tion and subject to the attached cond�tions. The development of the property described herein shall be subject to the - restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all municipal ordinances and State and Federal Statutes now in force, or which hereafter may be in force. 2. All applicable conditions of Resolution No. 78-119 and CUP 14-80 (amended) shall be met. 3. CC&R's to be submitted to Director of Environmental Services for review and approval prior to recordation of final Tract Map, with CC&R's to include but not be limited to the following provisions, to insure: A. Architectural and exterior color cor�patibility is maintained. B. Front yard landscaping compatibility. C. Lewis Homes shall act as third party to settle disagreements. D. Easements for use of driveway and other common areas. E. Definition of usage of common wall areas, and maintenance and repair of all common features.
