A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESER7,
CALIFORNIA, APPROVING A TENTATIVE TRACT MAP TO ALLOW 675
SINGLE FAMILY CONDOP�INIUM UNITS AT THE SOUTHWEST CORNER OF
COUNTRY CLUB DRIVE AND COOK STREET. '
CASE N0. TT 15640
WHEREAS, the City Council of the City of Palm Desert, California, did on
the 14th day of May, 1981, hold a duly noticed Public Hearing to consider the request
of SUNRISE COMPANY for approval of a Tentative Tract Map for 144 lots to allow cons-
truction of 675 single family condominium units in the PR-4 (Planned Residential
District, maximum 4 d.u./acre) zone, on property located at the southwest corner of
Country Club Drive and Cook Street, more particularly described as:
NE 4 of Section 9, and E z of the E 2 of the
NW 4 of Section 9, T5S, R6E, S8M
WHEREAS, the Planning Commission, by Resolution No. 699, has recommended
approval subject to conditions.
WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality Act,
Resolution No. 80-89", in that the Director of Environmental Services has determined
that the project will not have a significant impact on the environment and a Negative
Declaration has been prepared.
LJHEREAS, at said Public Hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said City Council did find
the following facts and reasons justified in the staff report to the Plar�ning Commis,-
sion dated April 15, 1981, to exist to approve the Tentative Tract Map: �
(a) That the proposed map is consistent with applicable �
general and specific plans. .
(b) That the design or improvement of the proposed sub-
division is consistent with applicable general and
specific plans.
(c) That the site is physically suitable for the type
of development.
(d) That the site is physically suitable for the proposed
density of development.
(e) That the design of the subdivision or the proposed
improvements are not likely to cause substantial
environmental damage or substantially and avoidably
injure fish or wildlife or their habitat.
(f) That the design of the subdivision or the type of
improvements is not likely to cause serious public
health problems.
(g) That the design of the subdivision or the type of
improvements will not conflict with easements, ac-
quired by the public at large, for access through
or use of, property within the proposed subdivision.
NOb1, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, as follows:
1. That the above recitations are true and correct and constitute
the findings of the Council in this case.
2. That it does hereby approve the above described Tentative Map
No. TT 15640 for the reasons set forth in this Resolution and
subject to the attached conditions.
FURTHER BE IT RESOLVED that the recommended conditions of approval do include

a requirement that the applicant pay in-lieu fees to comply with the requirements
of Article 26.48 of the City of Pa1m Desert Subdivision Ordinance. In return, the
City Council agrees to use said fees for park purposes in conformance with an adopted
master plan, within five (5) years of the recordation of the final map.

_. Prior to submittal of the Final Map, the applicant shall provide the
Department of Environmental Services with a list of proposed street
names with at least three alternatives. The approval of the final street
name shall be made by tF�e Director of Environmental Services.
=. Access rights to Country Club Drive and Cook Street shall be offered to the
City as a dedication on the Final Map.
=.. The C.C, & R's for this development shall be submitted to the Director of
Environmental Services for review, and finaT approval by the City Attorney
prior to the issuance of any building permits. Prior to recordation of
the fina] subdivision map, the applicant shall submit to the City Engineer:
a. The document to convey title.
b. Covenants and restrictions to be recorded (which have been approved).
c. Managemen� and maintenance agreement to be entered into with the
owners of the units of the project (which has been approved).

Improvement plans for water and sewer systems shall meet the requirements
of the respective service districts.
Area shall be annexed to appropriate Improvement Districts having juris-
diction over the subject area.
A11 dedicated land and/or easements required by this approval shall be
granted to the City of Palm Desert, without cost to the City and free of
ali liens and encumbrances.
All on-site utilities, including cable TV, shall be placed underground and
shall be completely concealed from view except certain appurtenances as
may be approved by the Director of Environmental Services.
I0. Complet� plans and specifications shall be submitied as required by Ordi-
nance to the City Engineer for checking and approval before construction
of any improvements is commenced. The subdivider shall submit "as built"
plans prior to acceptance of the subdivision improvements by the City.
11. In order to maintain reasonable fire protection during the construction
period, the subdivider shall maintain passable vehicular access to all
buildings. An adequate number of fire hydrants with required fire flows
shall be installed as recommended by the Fire Marshal.
12. Prior to recordation of the Final Map, the developer shall furnish the
original and three (3) copies of the water system plan to the Fire
Marshal for review.
13. All requirements of the City Fire Marshal from his letter of March 17, 1981,
shall be met as a pari of the development of this tract.

14. The water system shall be signed by a registered civil engineer and
approved by the water company, with the following certification: "I
certify that the design of the water system of Tract No. 15640 is in accor-
dance with the requirements prescribed by the City Fire Marshal."

Drainage shall be subject to approval of the City Engineer.
Applicant shall provide engineered data as requested.
16. All private streets shall be inspected by the Engineering Department
and a Standard Inspection Fee shall be paid.
17. All requirements of the Planning Commission action on the Development Plan
02-81 shall be met as a part of the development of ihis tract.
18. The applicant shall have twelve (12) months from the date of the approval
or conditional approvaT of the tentative map for filing of the final map
unless an extension of time of up to eighteen (18) months is granted by
a Resolution of the City Council.
19. Developer shall pay a fee in lieu thereof, as a condition of the Fina] Map,
for park and recreation purposes. The City shall commit the use of any such
fees received within a five year period.
20. Cook Street and Country Club Drive shall be dedicated to provided right-of-way
to 55 feet from centerline.
21. Cook Street and Country Club Drive shall be fully improved to City of Palm
Desert standards and specifications.
22. The radius of cul-de-sacs shall be a minimum of 40 feet.
23. Construction of vehicular underpass and golf cart pedestrian underpass shall
be coordinated with the development to the east of Cook Street in a timely
manner.
24. All overhead utility lines on the west side of Cook Street shall be under-
grounded.
25. All overhead utility lines on the south side of Country Club Drive shall be
undergounded.
26. Landscaping and maintenance on Country Club Drive and Cook Street shall be
provided by the homeowners association.
27. Traffic safety striping on Country Club Drive and Cook Street shall be provided
immediately upon completion of widening of the streets.
28. Minimum street grades shall be 0.4 percent.
29. Drainage and signalization fund fees as required by City ordinance shall be
paid prior to recordation of the final map.
30. Drainage facilities shall be provided per Ordinance No. 218 and the Master
Drainage Plan to the specifications of the Public blorks Director.
31. Additional storm drain construction sha71 be contingent upon a drainage study
by the private engineer.
32. Final Map not to be recorded until design changes, if required by approval of
preliminary plans by the Design Review Board are incorporated.
33, Blowsand planting to be provided along northern and western boundaries of
subdivision as approved by Design Review Board.
34. Subdivision to be provided with minimum six foot high solid masonry wall
around project (except for approved openings}, as approved by Design Review
Board.

Provide the following fire protection in accordance with the Uniform Fire Code:

1. Install a water system caoable of delivering 2500 GPM fire flow from an� fire
hydrant for a two hour duration in addition to domestic supply. The computa-
tion shall be based upon a minimum of 20 psi residual operating pressure in
i, the supply main from which the flow is measured at the time of ineasurement.
2. Install Riverside County super fire hydrants located at each street intersection
(a) but not greater than 500 feet apart in any direction.

A. Exterior surface of hydrant barrels and heads-shall be painted chrome yellol•�,
and the tops and nozzle caps shall be painted green.
3. Curbs sha11 be painted red 15 feet �n either direction from each hydrant.
3. Prior to recordation of the final map, the developer sha11 furnish the original
and tihree (3) copies of the water system plan to the Fire P4arshal for review.
4. The a�ater system plan shall be signed by a registered civil engineer and aporoved
by the water company, with the following certification: "I certify that the de-
sign of the water system in Tract �10. 15633, 15640, DP 02-81 is in accordance
with the requirements prescribed by the Fire Marshal." Upon approval, the
original plan will be returned to the developer.
5. Prior to delivery of combustible materials to the building site, the rec�uired
water system shall be installed, operating and delivering the required flow.
E. Cul-de-sac streets are limited to 750 feet in length, unless modified by City
Fire Marshal.
