PURPOSES. CASE N0. TT 17725 WHEREAS, the City Council of the City of Palm Desert, California, did on the 28th day of ��lay, 1981, hold a duly noticed Public Hearing to consider the request of JANICE SCHOEN for approval of a Tentative Tract �1ap to create a one lot subdivision for commercial condominium purposes on approximately .602 acres with- in the C-1, (General Commercial) zone, located on the south side of El Paseo, approximately 280 ft. west of Sage Lane, more particularly described as: Palm Desert Unit No. l, Block 1, Lot 4 WHEREAS, The Planning Commission, by Resolution Pdo. 708, has recom- mended approval subject to conditions. , �� , WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmentaa Quality Act, Resolution fVo. 80-89", in that the Director of Environmental Services has ' determined that the project is categorically exempt pursuant to section 15101 of the guidelines for implementation of the CEQA as amended. WHEREAS, at said Public Hearing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons justified in the Staff Report to the Planning Commission, dated May 5, 1981, on file in the Department of En- vironmental Services to exist to approve the Tentative Tract Map: (a) That the proposed map is consistent with appli- cable general and specific plans. (b) That the design or improvement of the proposed subdivision is consistent with applicable general and specific plans. (c) That the site is physically suitable for the type of development. (d) That the site is physically suitable for the proposed density of development. (e) That the design of the subdivision or the proposed � improvements are not likely ta cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat. (f} That the design of the subdivision or the type of improvements is not likely to cause serious public health problems. (g) That the design of the subdivision or the type of improvements will not conflict with easements, ac- quired by the public at large, for access through or use of, property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the above described Tentative f�1an f�o, TT 17725 for the reasons set forth in this Resolu- tion and subject to the attached conditions. The cievelopment of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations, and restrictions of all Municipal Ordinances and State and Federal statutes now in force, or which hereafter may be in force. 2. Ful1 public improvements including traffic safety lighting as required by Ordinance and the City Engineer shall be installed in accordance with City standards. 3. The CC&R's for this development shall be submitted to the Director of Environ- mental Services for review and approval prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the Director of Environmental Services: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 4. Improvement plans for water and sewer systems shall meet the requirements of the respective service districts. 5. Area shall be annexed to appropriate Improvement Districts having jurisdiction over the subject. � 6. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert, without cost to the City and free of all liens and encumbrances. 7. All on-site utilities, including cable TU, shall be placed underground and shall be com�letely concealed from view except certain appurtenances as may be approved by the Director of Environmental Services. Subdivider to record an agreement guaranteeing that the property will voluntarily be a part of any undergrounding district which is subsequently established by the City including the property in question; this agreement not to be applicable to service �ines that lead directly to the building. 8. Complete plans and specifications shall be submitted as required by Ordinance to the City Engineer for checking and approval before construction of any improvements is commenced. The subdivider shall submit "as built" plans prior to acceptance of the subdivision improvements by the City. 9. The subdivider shall comply with all requirements of the Fire ��larshal as delineated ir� his letter of April 24, 1981. 10. Drainage shall be subject to approval of the City Engineer. Applicant shall provide engineered data as requested. 11. All requirements of the Planning Commission action on the Design Review Case No. 90 C shall be met as a part of the development of this tract. 12. The total number of lots shall be limited to one. 13. The applicant shall have twelve (12) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time of up to eighteen (18) montl�s is granted by a Resolution of the City Council. 14. Drainage and Signalization Fund contributions as required by City Ordinance shall be made prior to recordation of the final map. 15. Curb and sidewalk to City of Palm Desert standards shall be installed.
