HomeMy WebLinkAboutCC RES 82-153RESOLUTION NO. 82-153 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PAL�Yt DESERT, CALIFORNIA, ESTABLISHING UNDERGROUNDING UTILITY DISTRICT NO. 7. WHEREAS, a duly noticed public hearing, pursuant to Section 12.12.00 of the Palm Desert ylunicipal Code, was held by the Palm Desert City Council on or about the hour of 7:00 p.m. on this 2nd day of December, 1982, in the council chambers of the Palm Desert City Hall; WHEREAS, the purpose of said hearing was to determine if the public necessity, health, safety, and welfare required the removal of above ground wires and poles and the underground installation of wires and facilities to supply electrical, communication, or similar services to the area referrPd to in the latest equalized assessment roll of Riverside County as APN 622-160-010; WHEREAS, said site has been and is commonly referred to as the Palm Desert Civic Center Site; WHEREAS, notice of such hearing has been given to all affected property owners as shown on the latest equalized assessment roll and to those utilities affected in this matter; and, WHEREAS, at said duly held hearing all persons wishing to express an opinion on the matter were given an opportunity to have their position expressed. NOW, THEREFORE, BE IT RESOLVED that the Palm Desert City Council hereby determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associated structures, in accordance with Rule 20 A based on the following firtdings: 1. The streets are extensively used by the general public and carry a heavy volume of ipedesirian or vehicular traffic, in that: � a) Fred Waring Drive is a major thoroughfare connecting the cities of Rancho Mirage, Palm Desert, Indian Wells, and Indio as wel! as unincorporated areas. b) Fred Waring Drive serves as an alternate route to Highway 111 when the highway is heavily used. c) Existing and projected land uses in the immediate vicinity include a college, civic center, and municipal park which by their nature generate heavy volumes of vehicular as well as pedestrian traffic both on San Pablo and Fred Waring Drives. 2. The street passes through a civic area as well as an area of unusual scenic interest to the general public, in that: a) Fred Waring Drive has been designated on the Palm Desert General Plan as a scenic highway. b) Such civic and recreation facilities as the Pa1m Desert City Hall, College of the Desert, and San Pablo Park abut the streets on which the proposed undergrounding will occur. 3. ►'he proposed undergrounding will avoiu and eliminate an unusually heavy concentration of overhead electric facilities. • BE IT FURTHER RESOLVED, as follows: 1. The underground installation of wires and facilities supplying electric communication, or similar or associated service on the described area is hereby established as Underground Utility District No. 7. 2. That all poles, overhead wires and associated overhead structures shall be removed and underground installations made in said underground utility district within the following times: a) Underground installation by utility companies and property owners and reconnections not later than December 1, 1983. RESOLUTION NO. 82-153 b) Removal of poles, overhead wires and either associated overhead structures not later than December 31, 1983.
