DOM A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALN DESERT, CALIFORNIA, VACATING A PORTION OF DEEP CANYON ROAD AND TORO ~ PEAK ROAD IN SAID CITY UNDER THE PROVISIONS OF PART D, DIVISION 9, OF THE STREETS AND HIGRIIAYS CODE OF THE STATE Of CALIFORNIA. 4HEREAS, the City Council initiated proceedings to vacate a portion of a street in the City of Palm Desert, as more particularly described in Exhibits "A" and "8" attached hereto, and the City Council finds that said notices of such vacation were published and posted as required by law; and WHEREAS, the City Council on the loth day of June, 1982, held a Public hearing as required by law, at which hearing all persons interested in or objecting to the proposed vacation were heard. and said public hearing was duly and regularly closed; and WHEREAS, the City Council of the City of Palm Desert considered such matter and finds from the evidence submitted that portions of the street described in Exhibits "A" and "B" are unnecessary for present or prospective public purposes. NOW. THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE as follows: That the following described portion of Toro Peak Road south of Old Prospector Trail and Deep Canyon Road south of Covered Wagon Trail in the City of Palm Desert be vacated subject to, and retaining all public utility easements existing under said public right of way -and construction of curb, gutter and paving to specifications of the City Engineer. Said portion of street to be vacated is located in the City of Palm Desert, County of Riverside, State of California, and is described as set forth in Exhibits "A" and "B" attached hereto. 11 The City Clerk of the City of Palm Desert, California, shall cause a certieied copy of this resolution and order to be recorded in the Office of the County Recorder of Riverside County, California.
