HomeMy WebLinkAboutCC RES 82-086RESOLU'fION NO. 82- 86 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ADOPTING ON BEHALF OF THE CITY OF PALM DESERT THE BY-LAWS FOR THE COVE COMMUIVITIES FIRE COMMISSION The City Council of the City of Palm Desert, California, DOES HEREBY RFSOLVE that the By-laws for the Cove Communities Fire Commission dated May 25, 1982, (attached hereto and made a part hereof as Exhibit "A"), are hereby approved. W N.��i�r�� �1�.� .��� � PR�4.*3LE The Cove Co�nuaities Fire Coamiission is estaclished pursuant to a Joint Powers Agreement sigaed by the cities cf Rancno '�.irage, Palm Desert and Indian Wells. The purpose for tbe for..i.:��on or �he C�rs Cc�unities Fire Co�mission is to establish a vehicle under which a system of fire services (suppression, protection, prevention and related rescue and paramedic services) can be admiriistered on an areawide and regional �asis. ARTICLE I Sectiou 1.OI. Thesa bylaws provide for the organization and administra- tion of the Cove Co�unities Fire Commission and are inteaded to supplemeat the Joint Powers Agreement. ARTICLE Z Functions Section 2.01. The duties of the Conunission include: a) Contract or otherwise provide for a system of �ire services (suppression, pzotection, prevention and related rescue and paramedic services) oa an areawide and regional basis. b) Serve as a forum for consideration, study and recommendation on areawide and regional fire sertiice �ro3le^s. c) Assemble informatioa helpful iA the consideration of problems peculiar to fire services in its service area and in the Coachella Valley. . d) Lxplore practical avenues fcr inter�overnmental cooperation, coordinatioa and act�oa in :tie ia�e:est o` =ocai public wel`are znd means O_* im�rovemen;. 1;1 ��'iz dGt:: �:.15�ro�1C:. The custodian shall on1S disburse Coamission funds on the basis of de�ands pre- �iousl3 approved by the Co�nission. ARTICLE 3 Co�ission �roce�::rzs Section 3.01. Meetings. The�Cove Conmrunities Fire Cou�ission shall �old reguiar meetings at Ieast once a month at a ti�ae and place to be fixed zrom time to time by the Co�ission. Special nee*ings r..ay be called at any time by giving the notice specified in Section 54956 of the Government Code. T:�e Ralph M. Brown Act (Sections 54950 et seq of the Government Code) shall� apply to all meetings of the Coaimission. Section 3.02. Special Committees. Special committees a:ay be created by the Coum�issioa from among its own membership. The special co�aittees may consist of, but not be limited to, two standing committees; one to consider fire suppression-related subjects and the other to consider rescue and para- medic-related subjects. The special committees shall consist of at least one representative from each of two member cities. The Chairman of the Conaaission shall appoint a co�nittee chairman from among the committee membership. The conmiittees will meet on call by the committee chairman. Appropriate notice of the committee meeting shall be given. Section 3.04. Membership. The Cove Cor.anunities Fire Commission shall consist of two elected officials fram each member City or other entity which is a signator to the Joint Powers Agreement. Each me�ber agenc� shall have two votes on the commission and each vote shall be vested in and be exercised b� an elected official. The commission shall act only when every agency is represented. Each agency may be represented b;• ane proay vote. Section 3.05. Of�icers. Annually, during t`�e r.:e^.tn or Uay, tne Couaaission s:�a�l elect a Chairman and Vice Chai�az '-o^ ���ng its :nembership. ARTICLE 4 Duties Section 4.01. The duties of the Chairman include the execution o= contracts or agreements authorized and approved by the Co:�^.ission and the assignment of staff functions. Assignments may be made to member agencies, �- which include, but are not lia:ited to, the following: a) T'ne pre?aration of Co�issien agendas w•ith the necessary staff work for said agennas. b) The preparation and distribution of minutes of all Co�aission and committee meetings. work program. c) The preparation of a proposed annual budget and d) Delegatioa of responsibilities for the administra- tion of annual contracts and agreements on behalf of the Commission. of the member agencies. e) The assignment of special tasks to representatives f) The preparation of an annual report and the recom- mendation to the Commission of an auditor to make t�e annusl audit of revenue and expenditures made on behalf of the Co�ission. .ARTICLE S Rules and Procedures Section 5.01. Pazliamentary Authorit�. Excert as othe-c.ise pro- vided herein or by the vote of the majority of inember agencies, the current edition of Kaberts Rules of Order shall constitute the oarliamentary avthority for the Co�nission. Section 5.02. Resolutions. These by-laws and a�� amendments thereto shall be approved by resolution of each member agenc5• before they are effective.
