A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF PALM DESERT, CALIFORNIA, DETERMINING THE
AMOUNT OF PROPERTY TAX REVENUE TO BE
EXCHANGED BETWEEN THE CITIES OF PALM DESERT
AND INDIAN WELLS RELATING TO LAFCO CASE NO.
82-19-4.
WHEREAS, the detachment of certain territory is being proposed from the City of
Palm Desert to be annexed to the City of Indian Wells being designated as LAFCO No. 82-
19-4;
WHEREAS, the cities of Palm Desert and Indian Wells are the only agencies whose
areas or responsibilities for services would be affected by said reorganization;
WHEREAS, the principal municipal services provided by the City of Palm Desert
will not diminish because of said reorganization;
WHEREAS, fire protection is provided via a tri-city arrangement of which both
Palm Desert and Indian Wells are members; and,
WHEREAS, the City of Palm Desert currently does not have a property tax and
thus will not lose any property tax revenues.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert as follows:
SECTION 1: That, with respect to the reorganization designated as LAFCO No.
82-19-4 the relative responsibilities for service by the cities of Palm Desert and
Indian Wells will be unaffected by said reorganization.
SECTION 2: That, based upon said determination as set forth in Section l, there
shall not be any transfer of property tax revenue generated within said territory
proposed to be detached and presently collected by the City of Palm Desert to the
City of Indian Wells for the provision of Municipal Services.
SECTION 3: That any property taxes legally accruing to the City of Indian Wells as
a result of the annexation shall belong to and be retained by the City of Indian
Wells.
SECTION 4: That the City Clerk is hereby authorized and directed to transmit a
certified copy of this resolution to the executive officer of the Local Agency
Formation Commission and the auditor of the County of Riverside, pursuant to
Section 99 of the State of California Revenue and Taxation Code.
PASSED, APPROVED and ADOPTED at a regular scheduled meeting of the Palm
Desert City Council, held on this 12th day of August, 1982, by the following vote, to wit:
