A RESOLUTION OF INTERPRETATION OF THE CITY
COUNCIL OF 'THE CITY OF PALM DESERT,
CALIFORNIA, PERTAINING TO THE ABILITY OF
PROPERTY OWNERS OF EXISTING DUPLEX UNITS IN
TRACT 2521 TO SUBDIVIDE THEIR PARCELS.
WHEREAS, Tract 2521 was developed as a duplex in the early 1960's with a
maximum density of one dwelling unit per 3000 square feet of lot area; and
WHEREAS, said units were developed with one two-dwelling unit structure per
parcel; and
WHEREAS, the vast majority of dwelling units were originally sold individually to
separate owners; and
WHEREAS, while the Palm Desert regulations for duplex units requires a minimum
of 4d�0 square feet of lot area per unit for duplex development said Tract 2521 existed
for more than ten years prior to the city's establishment; and
WHEREAS, the inability of existing owners to resell their individual units because
of the refusal of financial institutions to finance their resale without individually recorded
parcels; and
WHEREAS, present Palm Desert requirements, if strictly interpreted would
preclude the right of individual owners to file parcel maps establishing separate recorded
parcels; and
WHEREAS, it was never the intent of the existing ordinances to unduly penalize
and cause a hardship to the owners of these units; and
WHEREAS, a resolution of interpretation will alleviate said difficulties; and
WHEREAS, said resolution is exempted from th�, Califiornia Environmental Quality
Act of 1970, as amended.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, as follows:

That the above recitations are true and correct and support the finding that
this Resolution 83-24 will further the public health, safety, and general
welfare of athe City of Palm Desert.
That for duplex units in T'ract 2521 constructed prior to the incorporation of
Palm Desert and developed at a density of one dwelling unit per 3000 square
feet may be subdivided via the city's parcel map process.
This interpretation is made because of the unique circumstances surrounding
the development and subsequent sale of said Tract and will apply only to
said Tract.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City
Council held on this 24th day of March, 1983, by the following vote to wit:
