A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF PALM DESERT APPROVING
PETITION AND WAIVER OF PROPERTY
OWNERS FOR SPECIAL ASSESSMEPIT PRO-
CEEDINGS AND APPROVING BOUNDARY MAP
ATTACHED THERETO AND DIRECTING FILING
WITH THE CITY CLERK AND RECORDING WITH
COLIPITY RECORDER.
WHEREAS, this City Council proposes to take pro-
ceedings pursuant to the P�Iunicipal Improvement Act of 1913
for the acquisition and construction of certain subdivision
improvements, appurtenances and appurtenant works in that
certain subdivision designed as Tentative Parcel Map
No. 17452.
NOW, THERF.FORE, THE CITY COUNCIL OF THE CITY OF
PALM DESERT DOES HEREBY RESOLVE, DETERMIIIE AND ORDER AS
FOLLOWS:
Section 1. That the Petition and LJaiver, attached
hereto as Exhibit 1, and made a part hereof, is hereby
approved.
Section 2. That certain Boundary Map attached to
said Petition and Waiver of Property Owners, designed
"Proposed Boundaries of Assessment District No.83-�" is hereby
approved and ordered to be filed in the office of the City
Clerk and recorded in the office of the County Recorder of
Riverside County. �
PASSED, APPROVED, and ADOPTED by the City Council
of the City of Palm Desert, California, on this 26th day of
May , 1983, by the following vote, to wit:

PETITION AND WAIVER
ASSESSMENT DISTRICT NO.
(TENTATIVE PARCEL MAP NO. 17452)
TO: THE HONORABLE CITY COUNCZL OF THE CITY OF PALM
DESERT
The undersigned, being the owners of prop-
erties described below, hereby petition, for the takinq
of proceedings pursuant to the Municipal Improvement
Act of 1913, Division 12 of the Street and Highways
Code, and the issuance of bonds pursuant to the
Improvement Bond Act of 1915, Division 10 of said Code,
for the acquisition, installation and construction of
those certain onsite and offsite improvements, includ-
ing rough grading and flood control channel improve-
ments to comply with flood control requirements,
streets, bridges, curbs and gutters, sidewalks, land-
scaping, street lights, traff=ic signals, sewers and
sewer siphon, water lines, storm drains, conduit for
underground electrical, telephone, cable television and
natural gas facilities and all necessary appurtenances
and appurtenant works, within and as necessary to
provide access and services to said properties set
forth below, including without limitation, all engi-
neering and design, appraisal, legal, accounting and
financial consulting fees, land and right-of-way
acquisition, interest on the bonds during the con-
struction period, reserve funds and expenses of financ-
ing the district and expenses of all proceedings for
the authorization, issuance and sale of the bonds or
related thereto; and for the formation of an assessment
district consisting of those properties which shall be
assessed for the costs and expense of the improvements
described above, pursuant to said Municipal Improvement
Act of 1913. Attached hereto and marked Exhibit "A" is
a map and legal description of the boundaries of the
proposed assessment district.
The undersigned expressly waive the provi-
sions of the Special Assessment Investigation, imita-
tion and Majority Protest Act of 1931, Division 4 of
said Code in accordance with Section 2804 of said Code.

LEGAL DESCRIPTION
The South half of the Southeast quarter and the South-
east quarter of the Southwest quarter of Section 9,
Township 5 South, Range 6 East, San Bernardino Merid-
ian, according to the official plat thereof.
EXCEPT that portion lying within 42nd Avenue as con-
veyed t� the City of Palm Desert by Deed recorded
June 16, 1978 in Book 1978 page 123616, Official
Records.
ALSO EXCEPT Parcels 1, 2 and 3 and the land shown as
private streets thereon, of Parcel Map 13635 recorded
in Book 64 page 41, and re-recorded in Book 75 page 60
and in Book 80 page 40, of Parcel Maps, in the office
of the County Recorder of said County.
ALSO EXCEPT that portion thereof lying within Lot A of
Parcel Map 13635 recorded .in Book 64 page 41 and
re-recorded in Book 75 page 60 and in Book 80 page 40,
of Parcel Maps, in the office-of the County Recorder of
said County, which would pass by appurtenance upon a
