RESOLUTION N0. 83-85
A RESOLUTIOfJ OF THE CITY COUNCIL OF THE CITY OF PALM DESERT,
CALIFORNIA, VACATING A PORTION OF PALM DESERT DRIVE (NORTH)
AT MONTEREY AVENUE IN SAID CITY UNDER THE PROVISIONS OF PART
3, DIVISION 9, OF 7HE STREETS AND HIGHWAYS CODE OF THE STATE
OF CALIFORNIA.
WHEREAS, the City Council initiated proceedings to vacate a portion
of a street in the City of Palm Desert, more particularly described in Exhibit
"A" attached hereto, and the City Council finds that said notices of such
vacation were pub1ished and posted as required by law; and
WHEREAS, the City Council on the 25th day of August, 1983, held a
public hearing as required by law, at which hearing all persons interested in
or objecting to the proposed vacation were heard, and said public hearinq was
duly and regularly closed; and
WHEREAS, the City Council of the City of Palm Desert considered such
matter and finds from the evidence submitted that portions of the street
described in Exhibit "A" are unnecessary for present or prospective public
purposes.
NOW, THEREFORE, the City Council of the City of Palm Desert, California,
DOES HEREBY RESOLVE as follows:
That the following described portion of Palm Desert Drive (North) at
Monterey Avenue in the City of Palm Desert be vacated subject to and retaining
all public utility easements existing under said public right of way. Said
portion of street to be vacated is located in the City of Palm Desert, County
of Riverside, State of California, and is described as set forth in Exhibit "A"
attached hereto. Granting of said vacation shall also be subject to the
applicant providing an ingress/egress easement and the landscaping of the
vacated area.

The City Clerk of the City of Palm Desert, California, shall cause a
certified copy of this resolution and order to be recorded in the Office of the
County Recorder of Riverside County, California.
PASSED, APPROVED, and ADOPTED on this 25th day of August, 1983, by
the City Council of the City of Palm Desert, California, by the follawing vote,
to wit:
AYES: Jackson, Kelly, Snyder, Wilson & Puluqi
NOES: None
ABSENT: None

LEGAL DESCRIPTION FOR THE VACATION OF
A PORTION OF THE FRONTAGE ROAD NORTH OF HIGHWAY 111
Al1 that portion of Section 19, Township 5 South, Range 6 East, San Ber-
nardino Base and Meridian, in the County of Riverside, State of Califor-
nia, described as follows:
Commencing at the Southeast corner of Parcel "F" deeded to the Coachella
Valley County Water District according to Parcel Map thereof No. 15723,
filed in the Office of the County Recorder of said County, January 9, 1981;
Thence, Northwesterly along the Southerly line of said parcel, North
89°31'21" West, a distance of 50.00 feet to the Southwest corner of
said parcel;
Thence, continuing along said line North 89°31'21" West, a distance of
100.00 feet to an angle point, said point also being on the Easterly
line of Parcel 1 of said Parcel Map;
Thence, South 0°04'30" West, a distance of 170.01 feet to a point along
the Easterly line of said Parcel 1, said point also being the TRUE POINT
OF BEGINNING:
Thence, continuing from said TRUE POINT OF BEGINNING South 0°04'30" West,
a distance of 30.32 feet to a point along the Easterly line of Lot "A"
deeded to California State Division of Highways according to said Parcel
Map;
Thence, South 89°31'21" East, a distance of 225.00 feet to the beginning
of a 25.00-foot radius tangent curve, concave Northwesterly;
Thence, Northeasterly along the arc of said curve, through a central
angle of 90°00'42", a distance of 39.27 feet;
Thence, tangent to said curve North 0°04'30" East, a distance of 30.32
feet to the beginning of a 25.00-foot radius tangent curve, concave
Northwesterly;
Thence, Sou�hwesterly along the arc of said curve, through a central
angle of 90 00'42", a distance of 39.27 feet;
Thence, tangent to said curve North 89°31'21" West, a distance of
225.00 feet to the TRUE POINT OF BEGINNING and containing 0.180 acres,
more or less.
