HomeMy WebLinkAboutCC RES 84-144RESOLUTION NO. $4-144 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A 58 LOT TENTATIVE TRACT MAP LOCATED WEST OF THE PALM VALLEY STOR�'1�f CHANNEL 1VORTH OF THE PALM DESERT COMMUNITY CENTER. CASE NO. 'tT 19503 WHEREAS, the City Council of the City of Palm Desert, California, did on the 8th day of November, 1984, hold a duly noticed public hearing to consider a request by GEORGE FOX for approva! of a 58 lot tentative tract map and Negative Declaration of Environmental Impact to allow the construction of 58 units on 97.5 acres within the hillside planned development, drainageway overlay zone, located west of the Palm Valley Storm Channel north of the Palm Desert Community Center, more particuiarly described as: APN'S 640-100-001, 002 WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedures to Implement the California Environmental Quality Act, Resolution No. 80-89," in that the planning commission has determined that the project will not have a significant adverse impact on the environment and a negative declaration has been prepared. WHEREAS, at said public heacing, upon hearing and considering all testimony and arguments, if any, of all persons desiring to be heard, said city council did find the following facts and reasons to exist to approve the tentative tra�t map: 1. As conditioned by the associated developrnent agreement the proposed map its design, improvements, type of development and density are consistent with the State Subdivision AAap Act, Palm Desert Subdivision and Zoning Ordinances, General Plan and the West Hills Specific Plan. 2. 3. 4. The design of the subdivision will not result in substantial environmentai damage, injure fish or wildlife or result in public health problems. The design will not conflict with public easements. The design will allow unrestricted solar access to all lots. WHERPAS, in the review of this tentative tract map the city council has considered the effect of the contemplated action on the housing needs of the region for purposes of balancing these needs against the public service needs of the residents of the "- City of Palm Desert and its environs, with available fiscal and environmental resources. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, as follows: 1. 2. 3. That the above recitations are true and correci and constitute the findings of the city council in this case; That it does hereby approve Tentative Map vo. 19503 for the reasons set forth in this resolution and subject to the attached conditions. That a Negative Declaration of Environmental Impact is hereby approved. The development of the property described hereM shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations and restrictions of a!! municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 2. The applicant shal! have twenty-four (24) months from the date of this approval for filing of the final map unless an extension of time, as permitted by code, is granted by planning commission, 3. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director o# environmental services. 4. All dedicated land and/or easements required by this appcova! shall be granted to the City of Palm Desert or other appropriate agency, without cost and free of all liens and encumbrances. 5. "The CCacR's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shal! submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be recorded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 6. Prior to recordation of the final map the applicant must receive approval of a hillside development plan including final grading and drainage plan and a conceptual landscape plan showing treatment of scarred areas. 7. Prior to submittal of the final map, the applicant shall provide the department of environmenta! services with a list of proposed street names with at least three alternatives. The approval of the final street name shall be made by the director of environmental services. City Fire MarshaL• 8. 9. Install a water system capable of delivering 1500 GPM fire flow from any hydrant for a two hour duration in addition to domestic suppty. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. Install Riverside County super fire hydrants located at each street intersection. a. Not greater than S00 feet apart in any direction. b. All buildings shall be within 250 feet from a fire hydrant. c. Exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. d. Curbs shall be painted red 15 feet in either direction from each hydrant. 10. Prior to recordation of the final map, the developer shall furnish the original and three (3) copies of the water system plan to ihe fire marshal for review. 11. Minimum Street width is 28 feet. 14. Forty (40) foot radius turn-arounds shall be provided as part of each interseciion. 15. Buildings shall be set back at 25' from downhill slopes. 16. Each building site shall contain an approved hammerhead turn-around. 17. Slopes of streets shall not exceed 2096. 18. Flood control systems shall be separate fcom and shall pcotect vehicle travel ways. Department of Public Workx 19. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. 20. Drainage facilities shall be provided per Ordinance No. 218 and the master drainage plan to the specifications of the director of public works. 21. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 22. Improvement plans for water and sewer systems shall be approved by the respective service districts. 23. Compiete improvement plans and specifications shall be submitted as required by ordinance to the city engineer for checking and approval before construction of any improvements is commenced. The subdivider shal! submit "as-buili" plans prior to acceptance of the subdivision improvements by the city. 24. All private streets shall be inspected by the engineering department and a standard inspection fee shall be paid. 25. Storm drain construction shall be contingent upon a drainage study by the private engineer. 26. Traffic safety stripping on the public streets shall be provided to the speci#ications of the dicector of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 27. A minimum 200-foot centerline radius for the interior private streets shall be maintained throughout the project. 28. All proposed driveway locations shall only be conceptually approved with this development. Final approvat shall be done in accordance with the review of each individua! site grading plan. 29. The developer shall provide a 24-foot wide paved access from the Green Way Bridge to the southerly tract boundary. 30. A 60-foot right-of-way along the easterly tract boundary shall be dedicated to the city and fully improved to city public street standards based on a 36-foot curb separation. 31. Construction of an approved separation between the Palm Valley Channel and the public street shall be done as required by the city engineer. 32. Interior streets shall be constructed to the City of Palm Desert private street standards per the municipal code. 33. Street and grading plans to be approved by the public works department and a surety posted to guarantee the required improvements prior to recordation of the map. -3-
