HomeMy WebLinkAboutCC RES 84-149RESOLUTION NO. 84-149 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, DETERMINING THE METHOD FOR THE EXCHANGE OF PROPERTY TAX REVENUE BETWEEN THE CITY OF RANCHO MIRAGE AND THE CI'TY OF PALM DESER'f AS IT RELATES TO ANNEXATIONS TO AND DETACHMENTS FROM THE CITY OF PALM DESERT, CALIFORNIA. WHEREAS, the City of Rancho Mirage has made application to the Local Agency Formation Commission to annex certain property presently within the City of Palm Desert, located more particularly in the Rancho Las Palmas Country Club; and WHEREAS, as a part of that application the City of Rancho Mirage is also proposing that certain land located in the southeast guarter of Section 31 and which following the construction of Monterey Avenue will be located east of Monterey Avenue on the north side of the future Frank Sinatra Drive become a part of the City of Palm Desert; and WHEREAS, the City of Palm Desert supports the application as presently constituted. � NOW, THEREFQRE, BE IT RESOLVED by the City �ouncil of the City of Palm Desert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the counci! in this matter. 2. That in the above noted application before the Local Agency Formation Commission the exchange of property tax revenue shall be as follows: a. That in the matter of property located within a portion of the Rancho Las Palmas Country Club, the City of Rancho Mirage shall assume responsibility for all general municipal services to the area to be annexed to that city as are required by law or presentiy provided throughout the city, and for such service, the city shall receive that portion of the property tax revenue generated within territories annexed under the ad valorem tax rate established by Article XIII A of the Constitution of the State of California, that presently represents the City of Palm Desert's share of such property tax revenue. b. That in the matter of the property located within a portion of the southeast quarter of Section 31 north of the future Frank Sinatra Drive and east of the future Monterey Avenue, the City of Palm Desert shall assume responsibility for all general municipal services to the area to be annexed as are required by law or presently provided throughout the city, and for such service, the city shall receive that portion of the property tax revenue generated within territories annexed under the ad valorem tax rate established by Article XIII A of the Constitution of the State of California. 3. The City Council of the City of Palm Desert does hereby agree to the above- recited exchange of property tax revenue. PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert City Council, held on this 8th day of November, 1984, by the following vote, to wit: AYES: KELLY, PULUQI, WILSON, AND SNYDER NOES: NONE ABSENT: JACKSON ABSTAIN: NONE WA 'TER H.
