HomeMy WebLinkAboutCC RES 84-032r RESOLUTION N0. 84-32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, INITIATING PROCEEDINGS AND SET A HEARING DATE TO ANNEX CERTAIN CONTIGUOUS TERRITORY TO SAID CITY UNDER THE PROVISIONS OF THE MUIVICIPAL ORGANIZATION ACT OF 1977, WHICH PROCEEDINGS ARE DISIGNATED AS ANNEXATION NO. 17, LAFCO NO. 83-90-4. WHEREAS, on October 27, 1983, the City Council did adopt Resolution No. 83-112, instructing the city clerk to file an application with the Local Agency Formation Commission for Annexation No. 17, and thereby initiate preliminary proceedings; and WHEREAS, the distinctive short form designation of the proposed annexation is LAFCO NO. 83-90-4, Annexation No. 17 to the City of Palm Desert; and WHEREAS, Annexation No. 17 comprises approximately 258 acres generally located east of the Palms to Pines Highway (also known as Highway 74) and south of the existing city limits, or more particularly described as Exhibits "A" and "B" attached hereto; and WHEREAS, LAFCO determined that the territory to be annexed is uninhabited, there being fewer than 12 registered voters residing therein; and WHEREAS, the proposed annexation would be a logical expansion of the city boundaries, is consistent with the Municipal Organization Act which encourages limiting the number of annexatons to those areas considered logical growth areas and is of satisfactory size to provide municipal services without adversely affecting the rest of the community; and WHEREAS, the LAFCO resolution of approval provides that the annexation shall be subject to the terms and conditions which are presently imposed on similar annexations to the City of Palm Desert and the provisions of Government Code Section 35200 et se . NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: l. That a noticed public hearing on the proposed annexation be scheduled for April 26, 1984, at 7:00 P.M. in the Civic Center Council Chamber located at 73-510 Fred Waring Drive, Palm Desect. 2. Any owner of land within the territory may file a written protest against the annexation with the Clerk of the City at any time prior to the conclusion of the hearing scheduled in section 1 above.
