TURNER TO A DECISION OF THE PALM DESERT PLANNING COMMISSION DENYING A REClUEST FOR APPROVAL OF A CHANGE OF ZONE FROM PR-5 (P�ANNED RESIDENTIAL, S UNITS PER ACRE), PRECISE PLAN OF DESIGN TO ALLOW 80 RESIDENTIAL UNITS ON 4.85 ACRES UN TNE NURTH SIDE OF MAGNESiA FALLS DRIVE. 676 FEET EAST UF PURTOLA AVENUE AND A NEGATIVE OECLARATION OF ENV[RONMENTAL IMPACT AS IT PERTAIN THERETO. CASE NO'S. C/Z 85-10 AND PP 85-31 WHEREAS. the City Council of the City of Palm Desert. California. did on the 19th day of December, 1985 hold a duly noticed public hearing to consider an ��ppeal by JOHN M. TURNER to a decision of the Palm Desert Planning Commission denying a request for approval of a change of zone fr�xn PR-5 (plai�ned residential. 5 u�its per acre) to AHDPR-18 (affordable hiqh densi�y planned residential. 18 units per acre). precise plan of design to allow 80 resi��ential units and a negative declaration of environmental impact on 4.85 acre�� on the north side of Magnesia Falls Drive. 676 Feet east of Portola Aven��e more particularly described as: APN 624-120-004, 006 WHEREAS. at said public hearing. up�n hearing and considering all testimony and arguments of all interested persons desiring to be heard. said city council did find the following facts to exist to justify denial of the appeal. � l. The housing element estabiished a goal of 120� low ��nd moderate housing units to be achieved within a 5 year period. In the first " year more than 847. has been attained. This 847. tigur� does nor. include density bonus projects (ie: -i52 units at Mount.�in View Falls among others). 2. Six potential high density areas were delineated in the housing element, however, there was no guarantee that all six would be developed under the program. IF all six were to develop the city would achieve considerably in excess of the identified need of (200 units. The identified 1200 unit need was over a 5 year period. 3. 4. The impacts of the already approved and developed high density units in the city have not been adequately assessed. Approval of additional affordable high density projects at th9s time is premature.
