HomeMy WebLinkAboutCC RES 85-005RESOLUTION NU. 85-5 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN, TENTATIVE TRACT MAP, AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW A 26 UNIT CONDOMINIUM DEVELOPMENT ON 3.2 ACRES LOCATED AT THE SOUTHEAST CORNER OF PARKVIEW DRIYE AND FAIRHAVEN DRIVE. CASE NO. PP 84-24A dc T'f 20199 WHEREAS, the City Council of the City of Palm Desert, California, did on the 11 th day of April, 1985, hold a duly noticed public hearing to consider a request by ROBERT L. WARD for •appcoval of a precise plan, tentative tract map and negative decl�rat�on: of environme�tal impact to allow a 26 unit condominium development on 3.2 acres containing five units affordable by moderate income households to be located at the southeast corner of Parkview Drive and Fairhaven Drive. WHEREAS, the City Council of the City of Palm Desert held additional hearings culmenating on March 28, 1985 on said project. WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89", in that the director of environmental services has determined that the project will not have a negative impact on the environment and a negative declaration has been prepared. WHEREAS, at said public hearings, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts to justify their actions, as described below: Precise Plan: 1. The design of the proposed use reduced to single story structures, complies with the requirements of the zoning ordinance, will be compatible with surrounding uses, and will not depreciate property values in the vicinity. The site plan and architectural design equals or exceeds the standards of existing development in the vicinity. 2. The precise plan is consistent with the policies of the adopted Palm Desert General Plan and specifically implements the affordable housing goals of the housing element. Tentative Tract Map: 1. The proposed map, its design, improvements, type of devetopment, and density are consistent with the State Subdivision Map Act, the Palm Desert Subdivision and Zoning Ordinance, and General Plan. 2. The design of the subdivision insures that the project will not result in environmentat damage, injure fish or wildlife, degrade water quality or create public health problems. 3. 4. The map will not conflict with public easements. The map will allow unrestricted solar access to all lots. NOW, THEREFORE, BE 1T RESOLVED by the City Council of the City of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the city council in these cases; 2. i'hat the city council does hereby approve PP 84-24 Exhibit "A", TT 20199 Exhibit "B" on file in the department of environmental services, subject to attached conditions. 3. SNYDER, Ma r ATTEST: /dlg 0 RESOLUTION NO. 85-5 CONDITIONS OF APPROVAL CASE 1V0`S. PP 84-24A and TT 20199 Department of Environmental Services: 1. This approval is contingent upon execution of a development agreement specifying terms and conditions for the marketing of the moderate income units. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include;�but are not limited to, design review and building permits. 3. The development of the property shall conform with a!1 approved exhibits on file with the department of environmental services and to all municipal, state and federal statutes now in force, or which hereafter may be in force. 4. The applicant shall have twenty four (24) months from the date of the approval or conditional approval of the tentative map for filing of the final map unless an extension of time as permitted by code is granted by planning commission. 5. Construction of a portion of said project shall commence within one year from the date of final approval unless a time extension is granted; otherwise said approval shall become null, void and of no effect whatsoever. 6. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Riverside County Department of Health Palm Desert Architectural Commission City Fire Marshat Coachella Vattey Water District 7. Provisions for mail service shall be coordinated with the Palm Desert Branch U.S. Postal Service. 8. Location and design of trash enclosures shall be coordinated with Palm Desert Disposal Company. 9. All on-site utilities, including cable TV, shall be placed underground and shall be completely concealed from view except certain appurtenances as may be approved by the director of environmental services. 10. Drainage and signalization fund fees, as required by city ordinance, shall be paid prior to recordation of the final map. Department of Public Works: 1. All dedicated land and/or easements required by this approval shall be granted to the City of Palm Desert or other appropriate agency, without cost and free of all liens and encumbrances. 2. The CC dc R's for this development shall be submitted to the director of environmental services for review and final approval by the city attorney prior to the issuance of any building permits. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer: a. The document to convey title. b. Covenants and restrictions to be re�orded. c. Management and maintenance agreement to be entered into with the owners of the units of the project. 3. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the specifications of the director of pubiic works. 0 RESOLUTION NO. 85-5 4. Additional storm drain construction shall be contingent upon a drainage study by the private engineer. 5. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 6. Improvement plans for water and sewer systems shall be approved by the respective service districts. 7. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The subdivder shall submit "as-built" plans prior to acceptance of the subdivision improvements by the city. 8. Landscaping maintenance on Parkview Drive/Fairhaven shall be provided by the homeowner's association. 9. Existing utilities on Parkview Drive shall be undergrounded. 10. Traffic safety striping on Parkview Drive/Fairhaven shall be provided to the specifications of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 11. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 12. Property owner shall dedicate and fully improve sufficient right-of-way on Fairhaven Drive for one half of a 40 foot radius culdesac. 13. Installation of curb and gutter 32 feet from centerline and matching paving and sidewalk on Parkview Drive. 14. Applicant shall pay $628 school district impact fees, or as determined by the Desert Sands Unified School District. 15. Main access shall be from Parkview Drive; Fairhaven Drive access shall be limited to fire department use. 16. �n t�e development agreement, applicant agrees to limit the number of persons occupying a unit to one blood related family and to no more than 3 unrelated persons. 17. Applicant shall maintain the five foot setback area between garages and R-1 zoned area. City Fire Marshal: l. Install a water system capable of delivering 2500 GPM fire flow from any fire hydrant for a two (2) hour duration in addition to domestic supply. The computation shall be based upon a minimum of 7n ps� residual operating pressure in the supply main from which the flow is measured at the time of measurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. i 2. Install Riverside County super fire hydrants located at each intersection: � I ', a. Install Riverside County super fire hydrants so that no point of any building i is more than 250 feet from a fire hydrant measured along approved vehicular � travel ways. � ; b. Exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. c. Curbs shall be painted red 15 feet in either direction from each hydrant. � d. Hydrants shall not be located closer than 25 feet to any building. RESOLUTION NO 85-5 3. Prior to recordation of the final map, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. 4. Prior to issuance of a building permit, the developer shal! furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 5. The water system plan shall be signed by a registered civil engineer and approved by the water company, with the following certification: "I certify that the design of the water system in PP 84-24A and TT 20199 are in accordance with the requirements prescribed by the fire marshal." 6. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 7. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. City Council Conditions: 1. All buildings shall be one story. 2. Covered parking shall be within completely enclosed garages. 0
