HomeMy WebLinkAboutCC RES 85-006RESOLUTION N0. 85-6 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT ESTABLISHING UNDERGROUND UTILITY DISTRICT N0. 1985-1. The City Council of the City of Palm Desert, California, does resolve as follows: WHEREAS, a public hearing was called for on January 24, 1985, at the hour of 7:00 p.m., in the Council Chamber of the City Hall, Palm Desert, California, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication or similar or associated service on the easterly side of Portola Avenue from Fairway Drive proceeding south to the city limits; and on city-owned San Pablo park property north of the Civic Center; and WHEREAS, notice of such hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and WHEREAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Palm Desert hereby finds and determines that the public necessity, health, safety and welfare require the removal of poles, overhead wires and associ- ated structures, in accordance with Rule 20A for the following reasons: 1. Said street or road or right-of-way is extensively used by the general public and carries a heavy volume of vehicular traffic; 2. Said street or road or right-of-way adjoins or passes through a civic area or an area of scenic interest to the general public and the underground installation of wires and facilities for supplying electric, communication or similar or associated service on the easterly side of Portola Avenue from Fairway Drive proceeding south to the city limits; and on city-owned San Pablo park property north of the Civic Center and s�ich described area is hereby establ�shed as Underground Utility District No. 1985-1. RESOLVED, �URTHER, that all pules, overr,ead wires and a�sociated overhead structures shall be removad an� undergrosnd i�stallati�nG made ?.ii said u�lder- ground utility district within the following times; a. Underground installation by utility companies and property owners and reconnections not later than August l, 1985, or such later date as may be approved by City Council. b. Removal of poles, overhead wires and other associated overhead structures not later than August 1, 1985, or such later date as may be approved by City Council.
