HomeMy WebLinkAboutCC RES 86-012RESOLUTION N0. 86-12 A RESOlUTION OF NECESSITY OF THE C1TY COUNCIL OF THE CITY OF PALM OESERT, CALIFORNIA, TO ACQU[RE PERMANENT EASEMENTS TO CERTAIN REAL PROPERTY BY EMINENT OOMAIN FOR MUNICIPAL PURPOSES FOR STREET AND PUBLIC UTILITY PURPOSES WHEREAS, the C i ty Counc i 1 of the C i ty of Pa 1 m Desert, Caltfornia, set a hearing to consider a resolution of necessity to acquire permanent easements to certafn reai property hereinafter described; and WHEREAS, on January 23, 1986, the City Council of the City of Palm Desert, California, he�d a hear9ng in the City Councii Chamber, City Hall, 73-510 Fred Waring Drive, Palm Desert, California, in order to determi�e the necessity for acquisition of said real property by eminent domain proceedings for street and pubiic utility purposes. NOW, THEREFORE, the City Council of the City of Palm Desert, California, DOES HEREBY RESOLVE as follows: Section 1: The public interest and necessity require said project and require the acquisition of said property for the purposes stated. Sectlon 2: The taking of real property for municipal purposes by eminent domain proceedings is authorized by Section 37350.5 of the Government Code of the State of California. Section 3: The proposed project is planned and located in a manner Hhich wiit be the most compatib�e with the greatest public good and the least private injury. Section 4: The legai description of the reai property proposed to be acquired is attached hereto as Exhibit "A" and made a part hereof by this reference. BE IT FURTNER RESOLVED that the City Attorney be, and hereby i s, author t zed and d i rected to commence and ma i nta i n i n the name of the City of Palm Desert such actions and proceedings of eminent domain in the Superior Court of California, Caunty of Riverside, as are necessary to acquire, for the purposes and uses aforesaid, that certa i n rea 1 property wh i ch i s s i tuated i n the County of R i vers i de. the City of Palm Desert, State of California, as described above. ILLIGAN, TY CLERK CITY OF PALM DESER , CALIFORNIA � RESOLUTION N0. 86-12 EXHIBIT "A" LEGAL DESCRIPTION RIGHT-OF-WAY DEOICATION A portion of Palm Village Garden Tract in the NorthNest Quarter of Section 21, Township 5 South, Range 6 East, San Bernardino Base line and Meridian as recorded tn Map Book 21, pages 56 to 57 inclusive, Records of Riverside County, California, and more particulariy described as fol)ows: Beginning at the Northwest corner of Lot 114 of Palm Village Garden Tract, said point being the true point of beginning; Thence North 89p52'00" East a distance of 56.33 feet to a point, such point being the beginning of a tangent curve concave to the West and having a radius of 20.00 feet; Thence Southerly and Easteriy along said curve through a central angle of 90°05'00" and ARC length of 31.45 feet; Thence South 0°03'00" East a distance of 106.67 feet; Thence South 89°52'00" West a distance of 10.00 feet; Thence North 0°03'00" West a distance of 106.67 feet to a point, such point being the beginning of a tangent curve concave to the South and having a radius of 20.00 feet; Thence Northerly and Westerly along said curve through a central angle of 90°05'00" and ARC length of 31.45 feet; Thence South 89°52'00" West a distance of 46.33 feet to the true point of beginning.
