APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND PRECISE PLAN TO ALLOW CONSTRUCTION OF A 11.225 SQUARE FOOT OFFICE BUILDING LOCATED AT THE SOUTHEAST CORNER OF FRED WARING ORIVE AND FAIRHAVEN DRIVE. CASE NO: PP 86-48 WHEREAS. the Citv Council of the Citv of Palm Desert. California, did on the llth day of December. 1986 hold a duly noticed public hearing to consider a reQuest by MR. GERALD CHAZAN for approval of a neaative declaration of environ- mental imoact and a precise plan to allow construction of a 11.225 square foot office building located at the southeast corner of Fred Waring Drive and Fairhaven Drive. WHEREAS. said application �ias complied with the requirements of the "City of Palm Desert Procedures for Implementation of the California Environmentat Quality Act. Resolution No. 80-89", in that the director of community development has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared. WHEREAS. at said public hearinp. upon hearing and considering all testimony and arguments. if any. of all interested persons desiring to be heard. said city council did find the following facts to exist to justify thetr �ctions: FINDINGS FOR APPROVAL OF THE PRECISE PLAN: 1. The proiect meets all design standards of the OP zone and other r�pplicable City of Palm Desert Zoning Ordinances. 2. California. as follows: 1. That the above recitations are true and correct and constitute the fi�dings of the council in tt�1s case. 2. A negative declaration of environmental impact is hereby approved. 3. The develoAment of the property shall conform substantially with exhibits on file with the department of community development as modified by the following conditions. 2. The development of the property described herein shall be subject to the restrictions and limitattons set forth herein in additlon to all munlcipal ordinances and state and federal statutes now in force or which hereafter may be in force. 3. Construction of a portion of said project shall commence wlthin one year from the date of final approval unless a time extension is granted, other- wise said approval shall become null, vold and of no effect whatsoever. 4. Prior to issuance of a building permit for construction of any us� contem- plated by this approval. the applicant st►all first obtain permits and/or clearance from the followina aaencies: Riverside County Department of Health Palm Desert Architectural Commission C i tv F i re Mar st�a 1 Coachella Vallev Water District Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a bullding permit for the use contemplated herewitt�. 5. All roof mounted mechanical eauipment shall be screened from all sides with materials similar to buildina walls. 6. Trash provisions shall be approved by applicable trash company and ctty prior to issuance of building permit. 7. Project shall be subject to Art in Public Piaces fee per Ordlnance No. 473. Oeoertment of Public ilorks: I. Drainage and signalization fund fees. as required by city ordinance, sf�all be paid prior to grading permit issuance. 3 RESOLUTION N0. 86-122 Z. Storm drain construction shall be contingent upon a drainage study by the private englneer that is app�oved by the department of public works. 3. Full publlc improvements. including traffic safety lighting, as required by ordinance and the director of public works� shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted� as required by ordinance. to the director of public works for checking and approval before construction of any improvements is cortmenced. The enafneer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 5. AI1 private driveways and parking lots shall be inspected by the enaineerina department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Fred Waring Drive and Fairhaven Drive shall be provided by the property owner. 7. Complete grading plans and specifications sl�all be submitted, as requfred by ordinance. to the director of public works for checking and approval prior to issuance of any permits. 8. i nsta l l at i on of curb. gutter and matcFi i ng pav i ng and e i ght foot s i dewa l k on Fairhaven Drive. 9. Offsite improvement plans to be approved by public works department and a surety r�osted to guarantee the required offsite improvements prior to grading permit issuance. !0. Size. number and location of driveways to public works specifications with only two driveway approaches to be allowed to serve this property. 11. Grading permit issuance shall be subiect to the waiver of parcel map first being approved and recorded. 12. Any and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit by the department of public works. 13. A complete preliminary soils Investigation. conducted by a regtstered soils engineer. sh�ll be submitted to and approved by the department of public works prior to issuance of the grading permit. 4 r RESOLUTION N0. 86-122 CitY Fire Marshal: 1. Install a wbter system capable of delivering 3000 GPM fire flow from any fire hydrant for a 3 hour duration 1n addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of measurement. 2. Install Riverside County super fire hydrants so that no point of any building ts more than 200 feet from a fire hydrant measured along approved vehicular travei ways. a. exterior surface of hydrant barrels and heads shail be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnish the original and three copies of the water system plan to the fire marshal for review. Upon approval, one copy will be sent to the buildlnq department and the original will be returned to the developer. 4. The water system plan shall be staned by a registered civil engineer and approved by the water company with the following certification: "i certify that tt�e desian of the water system in PP 86-48 is in accordance with the requirements prescribed by the fire marshal". 5. Prior to delivery of combustible materials to the building site, the required water system shall be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. All buildings over 5000 square feet require an approved fire sprinkler system. /dig �i
