HomeMy WebLinkAboutCC RES 86-002RESO�UTION NO. 86-2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, ESTABLISHING UNOERGROUNOING UTILITY DISTRICT NO. 6 WHEREAS, a duly noticed public hearing, pursuant to Section 12.12.00 of the Palm Desert Municipal Code. was held by the Palm Desert City Council on or about the hour of 7:00 p.m. on January 9. 1986, in the Council Chambers of the Palm Desert Civic Center; WHEREAS, the purpose of said hearing was to determine if the public necessity, health, safety, and welfare required the removal of above ground wires and poles and the underground installation of wires and facilities to supply electrical, communication, or similar services to the area described in Exhibit A; WHEREAS, said site has been and is commonly referred to as the Portola Fire Station Site; WHEREAS, notice of such hearing has been given to all affected property owners as shown on the latest equalized assessment roll and to those utilities affected in this matter; and, WHEREAS, at said duly held hearing all persons wishing to express an opinion on the matter were given an opportunity to have their position expressed. NON. THEREFORE, BE IT RESOLVED that the Palm Uesert. City Council hereby determines that the public necessity. health, saf ety and welfare require the removal of poles, overhead wires and associated structures. in accordance with Rule 20 A based on the followinq findings: 1. The intersection of Portola and Country Club Drive is extensively used bY the general public and carry a heavy volume of pedestrian or vehicular traffic. 2. The projected land uses in the immediate vicinity include a fire station, which by its nature generates heavY volumes of vehicular traffiic, as well as emergency vehicle requirements. 3. The proposed undergrounding will avoid and eliminate an unusually heavy concentration of overhead electric facilities. BE IT FURTHER RESOLVED, as follows: 1. The underground installation of wires and facilities supplying electric communication, or similar or associated service on the described area is hereby established as Underground Utility District No. 8. PASSEO. APPROVED ANO ADOPTED by the City Council of the City of Palm Desert, on this 9th day of January, 1986, bv the following vote, to wit: AYES: BENSON.
