i A RESOLUT I ON OF THE C I TY COUNC I L OF THE C[ TY OF
PALM DESERT, CALIFORNIA, AFFIRMING THE DECISION
OF THE PLANNING COMMISSION APPROVAL OF A PREC[SE
PLAN OF DESIGN. PARCEL MAP AND NEGATIVE
DECLARATION OF ENVIRONMENTAL IMPACT FOR PROPERTY
LOCATED ON THE EASTERLY SIDE OF HIGHWAY 111,
BETWEEN PARK VIEW DR[VE AND FRED WARING DRIVE.

WHEREAS, the City Council of the City of Palm Desert. California, did on
the lOth day of April. 1986, hold a duly noticed public hearing to consider an
appeal to a decision of the Palm Desert Planning Commission.

did on the 4th day of March, 1986 hold a duly noticed public hearing to
consider the request of D 8 0 DEVELOPMENT/DSL SERVICE CORP. for approval of a
negative declaration of environmental impact and precise plan of design and
parcel map to consolidate parcels to create three new parcels on l9 net acres
to allow construction of a 228 room hotel with a restaurant on 11.7 acres. for
property zoned PC (4) S.P. located on the easterly side of Highway Iil,
between Park View Orive and Fred Waring Drive, more particularly described as:

WHEREAS, said application has complied with the requirements of the "City
of Palm Desert Procedure for Implementation of the California Environmental
quality Act, Resolution No. 80-89", in that the director of community
development has determined that the project will not have an adverse impact
ont he environment and a negative declaration of environmental impact has been
prepared.
WHEREAS. at said public hearing, upon hearing and considering all
testimony and arguments. if any, of all interested persons desiring to be
heard, said city council did find the following facts and reasons to affirm
the planning commission decision and justify granting approvai of said precise
plan.
1. The design of the precise plan will not substantially depreciate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.
3. The precise plan will not endanger the public peace, health. safety
or general welfare.
WHEREAS, at said public hearing. upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard. said city council did find the following facts and reasons to affirm
the planning cortmission decision to justify granting approval of said parcel

That the proposed map is consistent with appllcable general and
speciftc plans.
That the design or imprpvement of the proposed subdivision is
consistent with applicable�general and specific plans.
That the site is physically suitable for the type of development.
7hat the site is physically suitable for the proposed density of
development.
5. That the design of the subdivision or the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat.
6. That the design of the parcel map or the type of improvements is not
likely to cause serious public health probiems.
7. That the design of the parcel map or the type of improvements will
not conflict with easements, acquired by the public at large, for
access through or use of property within the proposed parcel map.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the council in this case.
2. That the decision of the planning cortmission as delineated in its
Resolution No. 1123 is hereby affirmed subject to the conditions
attached thereto.
PASSED, APPROVED and AOOPTED at a regular meeting of the Palm Desert City
Council, held on this lOth day of Apr;l, 1986 by the following vote, to wit:
