A RESOLUT I ON OF THE C I TY COUNC I L OF THE C I TY OF
PALM DESERT, CALIFORNIA, DENYING AN APPEAL AND
AFFIRMING CONO[TION N0. 8 OF PLANNING COMMISSION
RESOLUTION N0. 1153 RELAT[NG TO SCHOOL IMPACT
FEES.
CASE N0: PP/CUP 86-27
WHEREAS, the City Council of the City of Palm Oesert, California, did on
the 14th day of August. 1986 hold a duly noticed public hearing to consider an
appeal by HARRY SCHMITZ of planning commission condition no. 8, resolution no.
1153 requiring payment of school impact fees for a six unit senior apartment
project.
WHEREAS, at said public hearing, upon hearing and considering all testi-
mony and arguments, if any. of all interested persons desiring to be heard,
said city councii did find the following facts to exist to justify their
actions.
1. Condition No. 8 requiring school impact fees for all residential
projects regardless of age restrictions is consistent with city
policy and analysis of potential impacts conducted by the Desert
Sands Unified School District.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the council in this case.
2. That the appeal of condition no. 8, Planning Commission Resolution
No. 1153 is denied.
PASSED, APPROVED and ADOPTED at a regular meeting of the Palm Desert
City Council� held on this 14th day of August, 1986 by the following vote, to
wit:
