A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALiFORNIA, DENYING WITHOUT
PREJUDICE AN APPEAL BY INTERNATIONAL CH[LDREN'S
CENTER OF A DECISION OF THE PLANNING COMMISS[ON
DENYING A REQUEST BY INTERNATIONAL CHILDREN'S
CENTER FOR A CONDITIONAL USE PERMIT TO ALLOW
CONVERSION OF A SINGLE FAMILY DWELLING TO A
PRESCHOOL, FOR A MAXIMUM OF l00 CH[LDREN [N A
RESIDENTIA� ZONE AT 46-200 PORTOLA AVENUE.
CASE N0. CUP 87-13
WHEREAS, the City Councii of the City of Palm Desert, California, did on
the lOth day of December 1987, hold a duly noticed public hearing to consider
an appeal by INTERNATIONAL CHILDREN'S CENTER to the decision of the planning
cortmission denying a request for approval of a conditional use permit to allow
a preschool with a maximum of 100 children at an existing residential project
at 46-200 Portola Avenue, more particulariy described as:
APN 625-203-015, O16, 017 and O18
WHEREAS, the planning commission by its' resolution no. 1262 denied the
request for reasons specified therein; and
WHEREAS, the applicant has complied with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmental Quality
Act, Resolution No. SO-89", in that the director of environmental services has
determined that the project is a class 1 categorical exemption; and
WHEREAS, at said publi hearing, upon hearing and considering all
testimony and arguments, of all interested persons desiring to be heard, said
council did find the following facts and reasons to exist to justify the
denial without prejudice of said appeal:
The proposed location of the conditional use and the conditions under
which it will be operated and maintained would be detrimental to the
public health, safety or general welfare or be materially injurious'to
properties or improvements in the vicinity, specifically;
t. The added traffic generated by the proposed use would negatively
impact the vicinity.
2. The noise which would be generated by the use would negatively
impact area residents.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
l. That the above recitations are true and correct and constitute the
findings of the council in this case.

2. That the appeal to the decision of the planning cortmission in the
matter of Case No. CUP 87-13 is denied without prejudice for �easons
delineated above.
PASSED. APPROVED and ADOPTEO at a regular meeting of the Palm Desert
City Council, heid on this lOth day of December, 1987, by the following vote to
ait:
