APPROVING A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF A GAS STATION AS PART OF THE RESIDENCE INN PROJECT WITH[N 10 ACRES IN THE PC (4) S.P. AND PR-5 N, S.P. ZONE AT THE •NORTHEAST CORNER OF HIGHWAY I11 AND DEEP CANYON ROAO. CASE N0. PP 86-45 Amendment #2 WHEREAS, the City Council of the City of Palm Desert, California, d1d on the 8th day of January, 1987, hold a duly noticed public hearing and continued publlc hearing on February 26 to consider the request of THOMAS MILLER for the above descrlbed proJect; and WHEREAS, said application has complied with the requirements of the "City of Pa1m Desert Procedure for Implementatlon of the Callfornla Envlronmental Quallty Act, Resolutlon No. 80-89," tn that the dlrector of cortmuntty development has determined that the pro�ect will not have a signiflcent envtronmental impact and a negative declaration is hereby certified; and WHEREAS, at sald publlc hearing, upon hearing and considering all testimony and arguments, if any, of ali interested persons desiring to be heard, said city council did find the folloNing facts and reasons to exist to justlfy granting approval of said preclse plan: 1. 7he design of the precise plan will not substantlally depreciate property values in the vicinity. 2. The preclse plan will not unreasonably tnterfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan wllt not endanger the publlc peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the C1ty Council of the City of Palm Desert, California, as follows: � 2. Thet the above recitations are true and correct and constitute the findings of the commission in thls case; That approval of Precise Plan 86-45 Amendment #1 is hereby granted for reasons subject to the ettached condltions. The development of the property shall conform substantially with exhibits on file with the department of community development/p)anning, as modified by the following condittons. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrlctlons end limitattons set forth herein whtch are 1n addttlon to all municipai ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to iss.uance of a but(dtng permit for construction of any use contemplated by this approval, the appllcant shall first obtain permits and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Commission City Fire Marshal Public Works Department Palm Desert Water & Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of butlding and safety at the time of lssuance of a bu11d1ng permit for the use contemplated herewith. 5. The hotel shall provide solid-core or steel doors equipped wtth dead boit locks, door viewers and latch guards. 6. The addressing of the rooms should use even numbers to the left and odd numbers to the right to assist emergency vehicles in locating rooms. 7. Access to Highway 111 must be approved by Caltrans and City of Palm Desert Public Works department. 8. The requested assurances from the developer by the Hldden Palms Homeowners Association will become conditions of approval, and have been expressed as follows: 3 e RESOLUTION N0. 87-15 a. That there be no usable balconies on the north side of thelr property facing toward Hldden Palms. b. A 90 foot setback from the building line to the Hidden Palms wali will be provided on the northern property iine. c. That a mfnimum of two rows of existing date palms remain as a barrier between the Hidden Palms wall and the proposed parking area. d. That additional planting be done under the date palm barrier to a height capable of softening the effect of only seeing the palm tree trunks from Hidden Palms. e. That tile be used at the gas station building, rather than metal. f. That no obtrusive lighting be done on the north side to 111uminate the hot water building, parking area or planned amenities. g. That the trash enclosure be moved from the northwest corner for noise a�d odor consideration. 9. Handicap parking stalls shall be distributed appropriately throughout entire site. !0. Detalled parking lot and building lighting plan shail be submitted to staff for approval, subject to applicable lighting standards, plan to be prepared by a qualified lighting engineer. 11. Three to 3.5 foot mounding shall be provtded to sufficiently screen parking lot areas from streets. l2. Trash provisions shall be approved by applicable trash company and clty prior to issuance of building permit. l3. All roof-mounted mechanical equipment shall be screened from all sides with materials similar to building walls. 14. Project shall be subject to art in public places fee per Ordinance No. 473. 15. A parcel map filing shaii create parcels to the satisfaction of. the director of cortmunity development. l6. The architecture of the future restaurant shali be compatlble with the hotel. 17. All on-site utilities, including cabie television, shall be placed 4 RESOLUTION N0. 87-15 underground and shali be completely concealed from vieN except certain appurtenances as may be approved by the director of cortxnunity development. 18. O�ly delivery diesei trucks bu11t after 1974 shall be used. 19. All conditions of the archttectural commission shall be met. 20. The precise plan will contain and provide all items dellneated in the staff report dated December 16, 1986. 21. Decorative walls shall be compatible with adjacent developments. 22. The service station shall be redesigned to be more compatible wlth the Resldenee Inn to reflect the concerns identifted by the staff report dated December 16, 1986. 23. The date palms on the site shall be maintained. ln the event that a date palm dies or requires removal, it shall be replaced by a tree approved by city staff. Department of Public Norks: 1. Drafnage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Dralnage Pian, to the speciffcations of the director of public works. 3. Storm drain construction shall be contingent upon a drainage study by the prlvate engtneer that 1s approved by the department of public works. 4. Full publlc improvements, inciuding traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 5. Complete improvement plans and specificattons shall be submitted, as requtred by ordinance, to the city englneer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 6. All private driveways and parking lots shall be inspected by the engineering department and a standard inspection fee shali be paid prior to grading permit issua�ce. 7. Landscaping maintenance on Highway 111 and Deep Canyon Road shall be provided by the property owner. +� RESOIUTION Fq. 87-15 8. Existing utilitles on Highway 111 and Deep Canyon Road shall be undergrounded per each respective utility district's recortmendation. If determi�ed to be unfeasible applicant shall agree to participate in any future utility undergroundtng distrtct. 9. Traffic safety strlping on Highway 111 and Deep Canyon Road shall be provided to the speciffcations of the director of public works. A traffic control plan must be submltted to and approved by the director of public works before placing pavement markings. 10. Compiete grading plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 11. Dedication of 55/58 feet of right-of-way on Highway 111 and Deep Canyon shall be done prior to lssuance of any permits and approval of plans. 12. installatlon of curb and gutter, matching paving and 8 foot meandering sidewalk on Highway 111 and Deep Canyon Road. 13. Offsite improvement plans to be epproved by public works department and a surety posted to guarantee the required offsite improvements prlor to grading permit issuance. 14. Instailation of one-half landscaped median in Nighway !ll or cash payment for one-half the cost of landscaped median at the option of the director of public works. 15. Traffic analysis to the prepared for the project to address the speclflc impacts on existing networks (street and lntersections) and the proposed mitigation measures recommended for approval by the city. 16. Size, number and locatio� of driveways to public works specificattons wlth only three driveway approaches to be allowed to serve this property. 17. Complete parcel map shall be submitted as required by ordlnance to the director of public works for checking and approval and be recorded before issuence of any permits. 18. Any and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. 19. A complete preliminary soils investigation, conducted by a registered soils engineer, shali be submitted to and approved by the department of public works prior to issuance of the gradfng permft. � RESOLUTION N0. 87-15 20. Access to Highway 111 shall be restricted through ralsed medians, to right turn ingress and egress and approved by Caltrans. 21. A secondary access, 24 feet wide, shall be provlded on Deep Canyon Road at the project's north boundary. 22. Applicant shall provtde for bus turnout on Hlghway lil to the satisfaction of the director of public works and Sunline Transit Agency. 23. Al1 improvements within the State right-of-way shall be constructed to Caitrans standards. 24. Median islands at both project entrances as shown on the proJect site plan shail be conttnuous and extend into driveways far enough to preclude/minimlze potential vehicle conflict. 25. If trefflc confllcts develop, as determined by the director of public works, at the most southerly driveway on Deep Canyon Road appiicant shail modify drive to restrict movements to right turn ingress/egress only. 26. Access drlveways shall be a minimum of 24 feet for H1ghNay lll entry a�d Deep Canyon exit, and 18 feet for Highway 111 exit and Deep Canyon entry. 27. Existing signal at Deep Canyon and Highway 111 shall be modlfied to the satisfaction of both Caltrans and the City of Palm Desert. C1ty Fire Marshal: l. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi restdual operating pressure in the supply maln from which the flow 1s measured at the time of ineasurement. 2. Install Riverside County super fire hydrants so that no point of any bullding 1s more than 200 feet from a fire hydrant measured along approved vehlcular travel ways. a, exterior surfaces of hydrant barrels and heads shall be palnted chrome yellow, and the tops and nozzle caps shall be palnted green. b. curbs shall be painted red l5 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a buiiding pe�mit, the developer shall furnish the origlnal and two copies of the water system plan to the fire marshal for � RESOI.UT I ON N0. 87-15 review. Upon approval, one copy will be sent to the building department, end the orlginal will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by �he water company. wlth the following certlfication: "! certify that the deslgn of the water system in Case No. PP 86-45 is in accordance with the requtrements prescribed by the fire marshal." 5. Prior to delivery of combustible matertals to the building site, the requlred water system shali be instalied, operating, and delivertng the required flow. 6. Addltional flre protection requirements may be necessary when the appllcant submits specific plans for conslderation and approval. 7. All building over 5000 square feet require an approved flre sprinkler system. 8. All three story buildings must have a fire marshal approved fire alarm system. Cttv Council Conditio�s: 1. There will be no car wash on the gas station site. 2. The Mobil Mart will be limited in the type of products sold to automotive products normally and customarily associated with the sale of gasoline, snack type foods and soft drinks as specified in Exhibit A. No alcoholic beverages will be sold. 3. Hours of operation will be limlted to 6:00 a.m. to 11:00 p.m. Monday through Sunday. 4. Building permits for the gas station will not be issued until final inspection for the hotel foundation have occurred. The site may be graded as part of an overall grading plan encompassing the entfre site. 5. There w111 be no outside storage. 6. There will be no sales promotions of items sold in the Mobil mart. 7. The exit located to the north on Deep Canyon Road shall be built with a crashgate, designed to serve as a secondary access point should traffic and/or circulation problems arlse at the southern egress. 8. The architectural design of the gas station will be revlewed for approval by city councii. 0
