HomeMy WebLinkAboutCC RES 87-016� 1 RESOLUTION N0. 87-16 � A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, APPROViNG A GENERAL PLAN AMENOMENT FROM "PARK" TO "OPEN SPACE" AND FROM A CURVILINEAR ALIGNMENT OF HOVLEY LANE TO A STRA[GHT EAST/WEST LINE BETWEEN PORTOLA AVENUE AND COOK STREET; A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT AND A PRECISE PLAN OF DESIGN TO CONSTRUCT A GOLF COURSE PROJECT AND A MAXIMUM 120 RESIDENTIAL UNITS TO BE DEVELOPEO AT A LATER OATE ON 158 ACRES LOCATED ON THE NORTH SIOE OF HOVLEY LANE BETWEEN PORTOLA AVENUE ANp COOF( STREET. CASE NQS. PP 87-1 and GPA 87-1 WHEREAS. the City Council of the City of Palm Oesert. California, did on the 12th day of February, t987, hold a duly noticed public hearing and continued public hearing to February 26 to consider the request of MARRIOTTS DESERT SPRINGS DEVELOPMENT CORPORATION, for the above mentioned project; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementatio� of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have a significant impact on the environment and a negative declaration has been prepared; and WHEREAS, at said pubiic hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts and reasons to exist to justify granting approval of said precise plan: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: � � That the above recitations a�e true and correct and constitute the findings of the council in this case; That approval of Precise Plan 87-1 and General Plan Amenciment 87-1 are hereby granted for reasons subject to the attached conditions. The development of the property shall conform substantially with exhibits on file with the department of community development/pia�ning, as modified by the following conditions. 2. Co�struction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of a�y use contemplated by this approval, the applicant shall first obtain permits and/or clearance from the following agencies: Coachelia Vaiiey Water Oistrict Palm Desert Architectural Commission City Fire Marshal Public Works Department Palm Desert Water 8 Services District Evide�ce of said permit or clearance from the above agencies shall be presented to the department of building and safety at the time of issuance of a building permit for the use contemplated herewith. -� , a ..Y' 1 5. Perimeter screening wil) provide intermittent visual amenity as described in staff report dated January 20, 1987, to the satisfaction of the director of camx�nity development. 6. Project shall pay fees as determined by Desert Sands Unified School District. 7. Prio� to issuance of mitigation measures in (UMA INORNATA) habitat a fund to be used for Coachella Valley. C�ONDITIONS OF APPROVAI a building permit, the appiicant shell provide the form of $750 per acre for a Fringe-Toed Lizard preserve. Any fees coliected are to be placed in acquisition of land for a lizard preserve in the C] RESOLUTION N0. 87-16 8. Project shall be subject to Art in Public Places fee per Ordinance No. 473. 9. The applicant will pay fees to comply with the requirements of Article 2648 of the City of Palm Desert Subdivision Ordinance. In return, the city agrees to use said fees for park purposes in conformance with an adopted master plan within five (5) years of the recordation of the final map. Depertn�ent of Pub11C irorks: I. Drainage fund fees to a maximum of $4,800 per acre shall be paid prior to issuance of grading permit or bonded for at the dlscretion of city council. 2. At the discretion of city council, signalizatio� fund fees shall be utilized to pay applicants share of Cook and Hovley and Portola and Hovley signais. 3. Orainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Pian, to the specifications of the director of public works. 4. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 5. Full public improvements, including traffic safety lighting, as required by ordinance and the director of public works, shall be installed in accordance with city standards. 6. Improvement plans for water and sewer systems shall be approved by the respective service districts aith "as-built" pla�s submitted to the department of public works prior to the project final. 7. Complete improvement plans and specifications shall be submitted, as required by ordinance, to the city engi�eer for checking and approval before construction of any improvements is comrnenced. The engineer shall submit "as-built" p)a�s prior to the acceptance of the improvements by the city. � � All public streets shall be inspected by the engineering departme�t and a standard inspection fee shall be paid prior to grading permit issuance. Landscaping maintenance on Portola Avenue, Cook Street, and Hovley Lane shall be provided by the property owner. (0. Existing utilities on Cook Street shall be undergrounded per each respective utility district's recommendation. Traffic safety striping on Portola Avenue, Cook Street, and Hovley Lane shall be provided to the specificattons of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 12. Complete grading plans and specifications shall be submitted, as required by ordinance, to the city engineer for checking and approval prior to issuance of any permits. 13. Dedication of 11 feet of right-of-way on Cook Street and 44 feet of right-of-way on Hovley Lane, shall be done prior to issuance of any permits and approval of plans. l4, installation of curb and gutter, matching paving and eight-foot meandering sidewalk on Portola Avenue, Cook Street. and Hovley Lane. l5. Offsite improvement plans to be approved by public works department a�d a surety posted to guarantee the required offsite improvements prior to gradi�g permit issuance. 16. Full improvement of one-half of Hovley Lane based o� 88' scenic secondary street standards or standards approved by the City of Palm Desert as established in accordance with chapter 26, sectio� 26.40.040 C.P.D. Code, shall be bonded for and will be installed at such time development occurs on the south side of Hovley Lane or when final tract map is fiied for the residential portions of this project, whichever occurs first. l7. Installation of one-half landscaped median in Cook Street or cash payment far one-half the cost of landscaped median at the option of the director of public works. l8. Installation of sewers to serve this project. 19. Complete tract map(s) shall be submitted as required by ordinance to the city engineer for checking and approval and be recorded before issuance of pe►mits for any proposed residential units. 20. A�y and all off-site improvements shall be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. 21. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading pe�mit. E� R£SOLUTIOfi N0. 87-16 22. Applicant shall provide public access easements along Portola Avenue, Cook Street, and Hovley Lane for the purpose oF landscaping and bicycle paths. Fi�al width of said easement shall be to the satisfaction of the departments of publ ic works and cormx�nity development, accormiodate an attractive streetscape and be integrated with existing easements of adjacent projects. 23. Applicant shall agree to participate in and contribute their fair share to the Cook Street Extension Project ( to connect Cook Street to Interstate 10) when requested. 24. Applicant shall provide right-of-way/easements for future storm drain alignment as necessary in accordance with the city's master drainage pla� and as required by the director of public works. City Fire Marshal: 1. Install a aater system capable of delivering 2500 GPM fire flow from any fire hyd�ent for a two hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residuel operating pressure in the supply main from which the flow is measured at the time of ineasurement. � 2. [nstall Riverside County super fire hydrants so that no point of any building is more than 250 feet from a fire hydrant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red l5 feet in eithe� direction from each hyd�ant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prior to issuance of a building permit, the developer shall furnlsh the origi�al and three copies of the water system plan to the fire marshal for revlew. Upon approval, one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company with the following certification: "I certify that the design of the water system in PP 87-1 is in accorda�ce with the requirements prescribed by the fire marshal." 5. Prior to delivery of combustible materials to the building site, the C� � � . •. , , RESOLUTION N0. 87-16 required water system shail be installed, operating and delivering the required flow. 6. Additional fire protection requirements may be necessary when the applicant submits specific plans for consideration and approval. 7. All cul-de-sacs over 600' must have secondary emerge�cy vehicle access. S. Provide 40' radius on end of all cul-de-sacs. C 1 tY Cax�c i i Cond i t i o�s : 1. Pubiic improvements for Hovley Lane may be bonded for, with installation of the applicant's portion of the Hovley Lane improvements occurring at the time of approval oF the final tract map for the residential area, or when development occurs on the south side of Hovley Lane, whichever occurs first. 2. Finai design of bicycle paths along Cook and Portola Ave�ues shall be approved by the departments of public works and community development. � `3 a �
