HomeMy WebLinkAboutCC RES 87-025RE50LUT10N NO. 67-25 ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF �J PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN OF DESIGN TO ALLOW CONSTRUCTION OF A 21,580 SQUARE FOOT RETAIL BUILOING IN THE C-1 ZONE ON THE SOUTH S1DE OF HIGHWAY 111 AT THE C1TY'S WESTERN BOUNDARY. CASE N0. PP 87-7 WHEREAS, the C1ty Council of the City of Palm Desert, California, did on the 23rd day of April, 1987, hold a duly noticed public hearing to consider the request of LAUREL DEVELOPMENT COMPANY for the above described proJect; and WHEREAS, said application has complied with the requirements of the "City of Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-89," in that the director of community development has determined that the project will not have an adverse impact on the environment and a negative declaration of environmental impact has been prepared; and WHEREAS, at said publlc hearing, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said city council did find the following facts and reasons to exist to justify granting approvai of said precise plan, reaffirming the planning commission decislon: 1. The design of the precise plan will not substantially depreciate property values in the vicinity. 2. The precise plan will not unreasonably interfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Oesert, California, as follows: 1. That the above recitations are true and correct and constitute the findings of the councii in this case; 2. . That approval of Precise Plan 87-7 is hereby granted for reasons subject to the attached condition5. RESOLUTION N0. 87-25 CONDIT[ONS OF APPROVAL CASE N0. PP 87-7 Department of Comnunity Oevelopnent/Planninq: 1. The development of the property shall conform substantially wlth exhibits on file with the department of community development/planning, as modified by the following conditions. 2. Construction of a portion of said project shall commence within one year from the date of final approval unless an extension of time is granted; otherwise said approval shall become null, void and of no effect whatsoever. � 3. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municfpal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applicant shall first obtain permlts � and/or clearance from the following agencies: Coachella Valley Water Oistrict Palm Desert Architectural Commission City Fire Marshal Public Works Department Palm Desert Water and Services District Evidence of said permit or clearance from the above agencies shall be presented to the department of building and safety at the timP of issuance of a butlding permit for the use contemplated herewith. 5. Parking on Highway 111 will be concealed from view by a 3.5 berm, a wall, hedge, and landscaping to the satisfaction of the director of community development/planning. 6. An ingress only high speed driveway cut shall be designed to Caitrans standards. Department of Public Norks: l. 2. Dratnage and signalization fund fees, as required by city ordinance, shali be paid prtor to grading permit issuance. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department. of public works. 3 �I I I L � � RESOLUTION N0. 87-25 0 15. Any and all off-site improvements shall be preceded by the approvai of plans and the issuance of valid encroachment permit(s) by the California Department of Transportation. 16. A complete preliminary soils investigation, conducted by a registered soils engineer, shaii be submitted to and approved by the department of public works prior to issuance of the grading permit. 17. Applicant shall secure reciprocal ingress and egress access easements from the owner of lot to the north. 18. Southernmost ingress shall only be ailowed upon approval of Caltrans. Applicant must utilize existing ingress/egress to the north. Consideration shall be given to the city's FAU widening project and project design shall incorporate all aspects of said widening project. 19. Existing asphaltic concrete drafnage structure shall be removed and replaced with a concrete structure to tie into existing storm channel. Applicant shall submit plans for approval and secure vaitd encroachment permits from the department of transportation and the Coachella Valley Water District. 20. Applicant shall submit approved street improvement plans and proof of payment of lands and fees from the department of transportation to the city prior to issuance of the grading permit by the city. 21. All improvements within State right-of-way shall be per State Department of Transportation standards. Citv Fire Marshal: L. Install a water system capable of delivering 3000 GPM fire flow from any fire hydrant for a three hour duration in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from which the flow is measured at the time of ineasurement. Fire flow requirements will depend on built-in fire protection provisions of buildings. 2. Install Riverside County super fire hydrants so that no point of any building is more than 200 feet, or as approved by the fire marshal, from a fire hydrant measured along approved vehicular travei ways. a. � exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. curbs shall be painted red 15 feet in either direction from each hydrant. • �
