HomeMy WebLinkAboutCC RES 87-027RESOLUTION N0. 87-27 A RESOLUT I ON UF THE C I TY Ct�UNC I L OF THE C I TY OF � PALM DESERT, CALIFORN[A, APPROVING A PRECISE PLAN OF DESIGN AND NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT TO ALLOW CONSTRUCTION UF A 13 UNIT APARTMENT PROJECT LOCATED AT THE NORTH S[DE OF SHADOW MOUNTAIN ORIVE, APPROX[MATELY 750 FEET WEST OF PORTOLA AVENLIE. CASE N0. PP 87-3 WHEREAS, the City Counr_ii of the City of Palm Oesert, California, did on the 14th day of May, 1987, hold a duly noticed public hearing to consider the request of HSM PROPERT[ES for approval of a prer_ise plan of design and negative declaration of environmental impact to allow construction of a 13 unit apartment project on 40,500 squar-e feet in the R-3 zone on property �ocated on the north side of Shadow Mountain Orive, approximately 75Q feet west of Portola Avenue, more particularly described as: APN 627-273-013 ,3nd 014 WHEREAS, the Planning Commission of the City of Paim Desert did hold public hearings on this matter on March ,i, 1987 and April 7, 1987 and approved said project; and WHEREAS, said application has complied with the requirements of the "City � �f Palm Desert Procedure for Implementation of the California Environmental Quality Act, Resolution No. 80-8y,�� in that the director or community y development has determined th�st the oroject wili not have an adverse impact on the environment and a negative declaration h.�s been prepared; and WHEREAS, at said pubiic hearing, upon hearing ar�d considering all testimony and argument�, if any. �:,f all interested persons desiring to be heard, said city council did find the following facts and reasons to exist to justify the granting of approvai of said precise plan of des�gn: l. NOW, THEREFORE, BE iT RE7c�LVED by the City Council of the City o� Palm Desert, California, as follows: l. That the �bove recit,jtiOnS are true and c��rrect and constitute the findings of the c��uncii in this r_ase; RESOLUTION N0. 87-27 2. That approval of Precise Plan 87-3 is hereby grante�� for reasons subject to the attached conditions. 3. That a negative declaration of environmental impact is hereby certified. The development of the property will conform substantially with exhibits on file with the department of community development. as modified by the following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval, the applicant shall first complete all the procedural requirements of the city which include, but are not limited to, architectural commission and building permit procedures. 3. Construction of a porrion of said project shall commence within one year from the date of final approvai unless a time extension is granted, otherwise said approval shall become null. void and of no effect whatsoever. 4. The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all municipal ordinances an�� state and federal statutes now in force, or which hereafter may be in force. 5. Prior to issuance of a building permit for construction of any use contemplated by this approval, the applir_ant shall first obtain permits and/or clearance from the following agenr_ies: Riverside County Department of Healtr, Palm Desert ArchitPctural Commission City Fire M�rshal Co.3chella Valley Water District Palm Desert Property Owners Assor_iation 6. That prior to issuance �f building permit the nwner (developer) provide the city with evidence th�t he has naid the required srhooi mitigation fee to tne Desert Sands Unified S�_hool District. 7. That the end of the row of open parking spaces be screened form view by a minimum three foot high wall or other suitable method of screening to be determined by the architertural commission. 8. That trash encios�are(s) be locat?d to the satisfaction of Palm Desert Disposal and planning staff. 9. That the landscape perimeter strip between the open parking spaces and the perimeter wal) be provided as required by ordinance to the satisfaction of the city's �rchitectural commission. � RESOlUTION N0. 87-27 l0. Applicant shall join an undergrounding district for overhead utility lines. 11. That the approved plan shall locate any two story units adjacent to vacant property only. Public Morks Oepartment: 1. Orainage and signalization fund fees, as required by city ordinance, shall be paid prior to grading permit issuance. 2. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the department of public works. 3. Full public improvements, including traffic safety lighting as required by ordinance and the director of public works, shall be installed in accordance with city standards. 4. Complete improvement plans and specifications shall be submitted, as required by ordinance, t� the director of public works for checking and approval before constructinn of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. � 5. All private ��riveways and parking lots shall be inspected by the engineering department and a standard inspection fee shall be paid prior to grading permit issuance. 6. Landscaping maintenance on Shadow Mountain Orive shail be provided by the property owner. 7. Complete grading plans and specifications shall be submitted, as required by ordinance, to the director of public works for checking and approval prior to issuance of any permits. 8. Instaliation of six-foot wide sidewalk on Shadow Mountain Orive. 9. Offsite improvement plans to be approved by public works department and a surety posted to guarantee the required offsite improvements prior to grading permit issuance. l0. Size, number and location of driveways to public works specifications with one driveway approach to be allowed to serve this property. 11. Grading permit issuance shall be subject to the waiver of parcel map first being approved and recorded. 4 0 � , RESOLUTION N0. 87-27 l2. Any and all off-site improvements shali be preceded by the approval of plans and the issuance of valid encroachment permit(s) by the department of public works. l3. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. Fire Marshal: I. That the applicant comply with the requirements of the fire marshal as specified in his letter dated March 7, 1987. City Council: l. Applicant shall revise the structures to place the two story elements in the seven-plex to abut the vacant parcel to the north. 2. The two-story element in the four-plex structure shall be internally redesigned to have views not overlook the property to the west. /tm 5
