AND PR-5 N, S.P. ZONE AT THE NORTHEAST CORNER OF HIGHWAY 111 AND DEEP CANYON ROAD. CASE N0. PP 86-45 WHEREAS, the City Council of the City of Palm Desert, California, did on the 8th day of January, 1987, hold a duly noticed public hearing to conslder the request of THOMAS MILLER for the above described project; and WHEREAS, safd application has complied Nith the requirements of the "City of Palm Desert Procedure for Implementation of the California Envtronmental Quality Act, Resolution No. 80-89," in that the dlrector of cortimunity development has determined that the project will not have a significant environmental lmpact and a negative declaration is hereby certiffed; and WHEREAS, at satd public hearing, upon hearing and considering all testimony and arguments, if any, of all tnterested persons destring to be heard, said city council did find the following facts and reasons to exist to �ustify granting approval of said precise plan: 1. The desfgn of the precise plan wili not substantially depreclate property values in the vicinity. 2. The precise plan will not unreasonably f�terfere with the use or enjoyment of property in the vicinity by the occupants thereof for lawful purposes. 3. The precise plan will not endanger the public peace, health, safety or general welfare. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm Desert, California, as follows: 1. 2. That the above recitations are true and correct and constitute the findings of the city council in this case; That approval of Precise Plan 86-45 is hereby granted for reasons subject to the ettached conditions. The development of the property shall conform substantially with exhibtts on file with the department of community development/planning, as modtfied by the following condttions. 2. Construction of a portion of said p�oject shall commence withi� one year from the date of final approval unless an extenston of ttme is granted; otherwlse said approval shall become null, void and of no effect whatsoever. 3. The development of the property described herein shall be subject to the restrictions and 11m1tations set forth heretn which are in addltlo� to all municipal ordinances and state and federal statutes now in force, or which hereafter may be in force. 4. Prior to issuance of a butlding permit for constructlon of any use contemplated by this approval, the applicant shall first obtaln permits ' and/or clearance from the following agencies: Coachella Valley Water District Palm Desert Architectural Gortmission City Fire Marshal Public Works Department Palm Desert Water � Services District Evidence of satd permit or clearance from the above agencies shall be presented to the department of bullding and safety et the time of issuance of a building permit for the use contemplated herewith. 5. The hotel shall provide solid-core or steel doors equlpped with dead bolt locks, door viewers and latch guards. 6. The addressing of the rooms should use even numbers to the left and odd numbers to the right to asslst emergency vehicles in locating rooms. 7. Access to Nighway 111 must be approved by Caltrans and C1ty of Palm Desert Public Works department. 8. The requested assurances from the developer by the Hidden Palms Homeowners Association w111 become conditions of approval, and have been expressed as follows: 3 RESOLUTION N0. -4 � a. That there be no usable belconies on the north side of their property facing toward Hidden Palms. b. A 90 foot setbeck from the building line to the Hfdden Palms wall will be provided on the norther� property line. � .� c. That a minlmum of two rows of existing date palms remain as a barrie� between the Hidden Palms wall and the proposed parktng area. d. 7hat additional planting be done under the date palm barrier to a helght capabie of softening the effect of only seeing the palm tree trunks from Hidden Palms. e. That no obt�usive ltghting be done on the north stde to iliuminate the hot water buflding* parking area or planned amenities. f. 7hat the trash enclosure be moved from the northwest co�ner for noise and odor consideretion. 9. Handicap parking stalls shall be distributed appropristely throughout entire site. 10. Detailed parki�g lot and but�lding lighting plan shall be submitted to staff for approval. subJect to applicable ltghting standards, plan to be prepared by a quaiiffed lighting engineer. 11. Three to 3.5 faot mounding shall be provided to sufficiently screen parking lot areas from streets. 12. Trash provisions shatl be approved by applicable trash company end city prior to issuance of building permit. 13. All roof-mounted mechanical equipment shall be screened from all sides with materials simiiar to building wails. 14. Project shali be subject to art in public places fee per Ordinance No. 473. t5. A parcel map filing shall create parcels to the satisfaction of the director of community development. 16. The architecture of the future restaura�t shall be compatible with the hotel. 17. All on-site utiltties, including cable televlsion. shall be placed unde�grpund and shall be completely concealed fran view except certain appurtenances as may be approved by the director of community development. 4 i:����i1�I���=��Y�] l8. Only delivery diesel t�ucks built after 1974 shall be used. 19. Al1 conditions of the architectiural commission shall be met. 20. The precise plan w111 contain and provide all items delineated in the staff report dated December 16, 1986. 21. Decorative walls shall be compatible wlth adJacent developrnents. 22. The date palms on the site shall be maintained. In the event thet a date palm dies or requires removal� it shall be replaced by a tree approved by city staff. Department of Public Works: 1. Drainage a�d sSgnalizatfon fund fees, as requtred by city ordinance, shall be pald prior to grading permit issuance. 2. Drainage facilities shall be provided, per Ordinance No. 218 and the Master Drainage Plan, to the speciflcatlons of the di�ector of public works. 3. Storm drain construction shall be contingent upon a drainage study by the private engineer that 1s approved by the department of public works. 4. Full public improvements, including traffic safety lighting, as required by ordlnence and the dlrector of publlc works, shall be installed 1� accordance with city standards. 5. Complete improvement plans and specifications shall be submltted, as required by ordinance, to the city engineer for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to the acceptance of the improvements by the city. 6. All private driveways a�d parking {ots sha11 be inspected by the engineering department and a standard lnspection fee shall be pald prior to grading permit issuance. 7. Landscaping mainte�ance on Highway I11 and Oeep Canyon Road shall be provided by the property owner. 8. ExSsting utilfties on Highway lil and Deep Canyon Road shall be undergrounded per each respective utility district's recommendation. If determi�ed to be unfeasible applicant shall agree to participate in any future utility undergroundfng district. 5 RESOLUT[ON N0. 87-4 9. Traffic safety strlping on Highway lll and Deep Canyon Road shall be provided to the specificattons of the director of public works. A traffic control plan must be submitted to and approved by the director of public works before placing pavement markings. 10. Complete grading plans and speclflcations shall be submitted, as required by ordinance, to the director of public works for checking and approval prior to Issuance of a�y permits. ll. Dedication of 55/58 feet of right-of-way on Highway 111 and Deep Canyon shall be done prior to lssuance of any permits and approval of plans. 12. Installation of curb and gutter, matching paving and 8 foot meandering sidewalk on Highway 111 and Deep Canyon Road. '' � 13.. Offsite improvement plans to be epproved by publlc works departme�t and a surety posted to guarantee the requlred offslte improvements prlor to grading permlt issuance. 14. Instailation of one-half landscaped median in Highway 1l1 or cash payment for one-half the cost of landscaped median at the optton of the dlrector of public works. 15. Traffic analysis to the prepared for the project to address the specific tmpacts on existing netNorks (street and intersections) and the proposed mitigation measures recommended for approval by the city. 15. Size, number and location of driveways to publfc works specificetions with only three driveway approaches to be allowed to serve thls property. 17. Complete parcel map shall be submltted as required by ordinance to the director of public Norks for checking and approval and be recorded before issuance of any permits. 18. Any and all off-site improvements shall be preceded by the approval of plans and the issua�ce of valid encroachment permit(si by the department of public works. 19. A complete pre11m1�ary soils lnvestigation. conducted by a regtstered soils engineer, shall be submitted to and approved by the department of public works prior to issuance of the grading permit. 20. Access to Highway 111 shall be restricted through raised medtans, to right turn ingress and egress and approved by Caltrans. 21. A secondary access, 24 feet wide, shall be provided on Deep Canyon Road at the project's north boundary. 3 RESOLUTION N0. 87-4 22. Applicant shall provide for bus turnout on Highway 111 to the satisfaction of the director of public aorks and Sunitne Tra�sit Age�cy. 23. All imp�ovements within the State right-of-way shall be constructed to Caltrang standerds. 24. Median islands at both project entrances as shown on the project site plan shall be continuous and extend into drtveways far enough to preclude/minimize potenttal vehicle conflict. 25. If traffic conflicts develop, as determined by the dlrector of public works, at the most southerly driveway on Deep Canyon Road applicant shall modify drive to restrict movements to right turn ingress/egress only. 26. Access drlveways shall be a mi�imum of 24 feet for Highway 111 entry and Deep Canyon exit, and 18 feet for Highway 111 exit and Oeep Cenyon entry. 27. Exfsting signal at Deep Canyon and Hlghway lll shall be modlfled to the satisfactlon of both Caltrans and the City of Palm Desert. City Fire Marshals l. Install a water system capable of delfvering 3000 GPM fire flow from any fire hydrant for a three hour duratio� in addition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply mafn from which the flow 1s measured at the time of ineasurement. 2. Install Riverside County super fi�e hydra�ts so that no point of any building is more than 200 feet from a fire hydrant measured along approved vehicular travel ways. a, exterior surfaces of hydrant barrels and heads shall be painted chrome yellow, and the tops and nozzle caps shall be painted green. b. curbs shall be painted red 15 feet in either direction from each hydrant. c. hydrants shall not be located closer than 25 feet to any building. 3. Prtor to issuance of a buflding permit, the developer shall furnish the original and two copies of the water system plan to the fire marshal for revlew. Upon approval, one copy wiil be sent to the bullding department, and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water campany, With the following certificat{on: "{ 7 RESOLUTION N0. 87-4 •• . � certify that the design of the water system 1n Case No. PP 86-45 is in accordance with the requlrements prescrlbed by the f1�e marshal." 5. Prtor to delivery of combustible materials to the butldtng s1te, the required water system shall be installed, operating, and delivering the required flow. 6. Additional fire protection requirements mey be necessary when the appllcant submits specific plans for consideration and approval. 7. All buitding over 5000 square feet require an approved fire sprinkler system. 8. All three story buildings must have a fire marsha) approved fire alarm system. , �
