A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT. CAL[FORNIA. APPROV[NG A NEGATIVE
ODEC�ARATION OF ENVIRONMENTAL IMPACT AND A
PRECISE PLAN FOR AN OFFiCE COMPLEX TO BE LOCATED
ON THE NORTH SiDE OF FRED WARING DR1VE BETWEEN
ADONIS DRIVE AND ACACIA ORIVE.
CASE N0: PP 87-14
WHEREAS, the City Council of the City of Palm Desert. California, did on
the 25th day of June. 1987. hold a duly rioticed public hearinq to consider
a request by RAY-AL ENTERPRISES 1NC. for approval of a negative declaration of
environmental impact and a precise plan for an office complex to be located
on the north side of Fred Waring Drive between Adonis Drive and Acacia Drive;
and
WhEREAS, said application f�as compli�d with the requirements of the "City
of Palm Desert Procedures to Implement the California Environmentel Quality
Act. Resolution No. 80-89", in that the director of community development has
determined that the project will not have an adverse impact on the environment
and a negative declaration has been prepared; and
WHEREAS, at said public hearing, upon f�earing and considering all testi-
mony and arguments, of all interested persons desirinq to be heard. said
City Council did find the following facts and reasons to exist to justify tfie�
granting of safid precise plan of design:
1. The proposed professional office developR�ent complies witl� the
standards of the O.P, zone and ott�er applicable city ordinances and
is consistent with intent of tt�e Palma Village Specific Plan.
2. The site plan and arcf�itecture are compati�le witt� adjacent land
uses.
3. The project will therefore not depreciate adjacent property values,
restr i ct the 1 awfu 1 use ttiereof nor w i 1 1 i t present a tf�reat to the
public health safety or general welfare.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
1. That the above recitations are true and correct and constitute the
findings of the City Council in tf�is c�se.
2. That a negative declaration of environmental impact Exf�ibit "A".
and Precise Plan 87-14 on file in tlie Department of Community
Development/Plenn(ng is here�y approved subject to conditions.

CONDIT[ONS OF APPROVAL
CASE N0. PP 87-14
Department of Com�+unitv Developnent:
1. The development of the property shall conform substantially with exhibits
on file with the department of conmunity development, as modified by the
following conditions.
2. Prior to the issuance of a building permit for construction of any uses
contemplated by this approval, the applicdnt shali first complete all the
procedural requirements of the city which include. but are not limited
to, architectural commission and building permit procedures.
3. Constructfon of a portion of said project st�all commence within one year
from the date of final approval unless a time extension is granted,
otherwise said approval shall become null. void and of no effect
whatsoever.
4. The deveiopment of the property describecf herein shail be subject to the
restrictions and limitations set forth her•ein wt�ich are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
5. Prior to lssuance of a building permit for construction of any use
contemplated by this approval, the applicant sf�dll first obtain permits
and/or clearance from the following agencies:
Riverside County Department of Heaith
Palm Desert Architectural Commission
City Fire Marshal
Coachella Valley Water District
Palm Desert Property Owner's Association
6. That prior to issuance of buiiding permit the owner (developer> provide
the city with evidence t��at fie has paid the required scl�ool mitigation
fee.
7. The trash enclosures sY�all be located as approved by Palm Desert Disposal.
8. That the landscaping perimeter strip between the open parking spaces and
the perimeter wall be provided as required t�y ordinance to the
satisfaction of the city's arcf�itectural corronission.
9. That the applicant enter into an agreement witri the city guaranteeing
that tt�e property will voluntarily be a part of �ny undergrounding

district which may be established by the city, including the property in
yuestion. The form of this agreement st�all be acceptable to the city
attorney and shall run with the land. This condition shall not be
apPlic�ble to the service lines that lead directly to the building(s)
which must be undergrounded.
10. Applicant shall install signage at each exit directing traffic toward
Fred Waring to the satisfaction of the departments of community
development and public works.
Department of Public Morks:

Drainage and signalization fund fees. as required by City ordinance,
shall be paid prior to grading permit issuance.
Storm drain construction st-�all be contingent upon a drainage study by tf�e
prtvate engineer that is approved by the Department of Public Works.
3. Full public improvements. including traffic safety liqhting. as required
by ordinance and the Director of Public Works, shall be installed in
accordance with City standards.
4. Complete improvement plans and specificdtions sf�all be submitted. as
requ i red by ord i nance. to tf�e D i rector oF Put� 1 i c Wor•ks for cf�eck i ng and
approval before construction of any irnprovements is commenced. The
engineer shall submit "as-built" plans prior to tf�e acceptance of the
improvements by ttie City.
5. All private driveways and parking lots shall be inspected by tt�e
engineering department and a standard inspection fee sfiall be paid prior
to gradiny permit issuance.
6. Landscaping maintenance on Acacia Or.. Adonis Dr.. and Fred Waring Orive
shall be provided by the property owners.
7. Existing utilittes on Fred Waring Drive and within sub�iect site shall be
underground per each resper_tive utility distrlct's r•econunendation. if
determined to be unfeasible applicant shall agree to participate in any
future utility undergrounding district.
8. Complete grading plans and specifications sfiall be submitted. as reUuired
by ord i nance, to the D i rector of Pub 1 i c Works for• ct�eck i ng and approva 1
prior to issuance of any permits.
9. Installation of curb and gutter and m�tching paving on Acacia Drive and
Adonis Drive, and eight foot wide sidewalk on Fred Warinq Drive.

10. Offsite improvement plans to be approved by F'ublic Works Department and a
surety posted to guarantee tf�e required offsite improvements prior to
greding permit issuance.
11. Size, number and location of driveways to Public Works specifications
with only two driveway approaches to be allowed to serve this property.
12. Complete parcel map shall be submitted as required by ordinance to the
Director of Public Works for checking and approval and be recorded before
issuance of any permits.
13. Any and all off-site improvements shall be preceded by the approval of
plans and the issuance of valid encroachment permits by the Department of
Public Works.
14. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the Department of
Public Works prior to issuance of tf�e gradinq permit.
15. Applicant shall secure reciprocal ingress and e�ress access easements
from the owners of lots 25, 26, 27, 28 and 29. frontaqe.
16. Direction of angled parking spaces sf�ould be reversed to allow for
smoother traffic flow in parking lot.
17. [nstallation of handicap rarnps at botf� curb returns. with sidewalk
wrapping around entire radius of curb returns.
Citv Fire Marshal:
1. Install a water system capable of delivering 3UUU GPM fire flow from any
f i re hydrant for d 3 hour durat i on i n add i t i on to domest i c supp 1 y. TF�e
computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which tt�e flow is measured at the time of
measurement.
2. Install Riverside County super fire r�ydrants so that no point of any
butlding is more than 200 feet from a fire liydrant measured along approved
vehicular travel ways.

c. hydrants shall not be located cioser than 25 feet to any buifding.
3. Prior to issuance of a building permit, the developer shall furnish the
original and three copies of the water system plan to the fire marshal
for review. Upon approval. one copy will be sent to the building
department and the original will be returned to the developer.
4. The water system plan shall be signed by a registered civil engineer and
approved by the water company witFi tf�e following certification: "l
certify that the design of the water system in PP 87-14 is in accordance
with the requirements prescribed by the fire marshal".
5. Prior to delivery of combustible materials to the building site. the
required water system shall be installed, operating and dellvering the
required flow.
6. Additional fire protectlon requirements may be necessary when the
applicant submits specific plans for consideration and approval.
7. All buildings over 5000 square feet require an approved fire sprinkler
system.
8. Driveway entrance to have 50' turning radius.

PROJECT DESCRIPTION/LOCATION:
Change of zone from R-2 to Office Professional and a precise plan for a one
story 17,105 square foot office complex on the north side of Fred Waring Drive
West of Monterey Avenue between Acacia Drive and Adonis Drive.
The Director of the Department of Community Development. City of Palm Desert,
California, has found that the described pro.ject wiil not have a si9nificant
effect on the environment. A copy of the initial study f�as been attached to
document the reasons in support of this finding. Mitiqation measures. if any,
included in the project to avoid potentially significant ef�ects. may also be
found attached.
