APPROVING A NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT ANU A PRECISE PLAN FOR THE REMODEL AND EXPANSION OF A SERIES OF BUILDINGS AT THE SOUTHEAST CORNER OF HIGHWAY 111 AND LARKSPUR LANE. CASE M0: PP 87-19 WHEREAS. the City Council of the City of Palm Desert. California, did on the 25tF� day of June, 1987. hold a duly noticed public f�earing to consider a request by SION GANNON for approval of a negative declaration of environmental impact, and a precise plan for tt�e remodel and expansion of a series of buildings at the southeast corner of Highway 111 and Larkspur Lane. The remodel sliall involve 9927 square feet of existing space. The expansion shall include 6457 square feet of first floor area and 3577 square feet of second floor space; and WHEREAS. said application has comptied with the requlreR�ents of the "Ctty of Palm Desert Procedures to Implement the California Environmental Quality Act. Resolution No. 80-89". in that tf�e director of community development has determined that the project will not have an adverse impact on the environment and a negative declaratfon has been prepared; and WHEREAS. at said public hearing, upon hearing and considering all testi- mony and arguments, of all interested persons desirinq to be heard� said City Council did find tt�e followinq facts and reasons to exist to justify tf�e granting of said precise plan of design: 1. PP 87-19 Department of Cortmunity Developnent: 1. The development of the property sf�all conform substantially with exhibits on file with the department of community development. as modified by tlie following conditions. 2. Prior to the issuance of a building permit for construction of any uses contemplated by this approval. the applicant shall first complete all the procedural requirements of the city wt�icf� include. but are not limited to, architectural commission and building permit procedures. 3. That prfor to issuance of building permit the owner (developer) provide the city with evidence that t�e has paid the required school mitigation fee. 7. That the applicant enter into an aqreement witt� the city quaranteeinq that the property will voluntarily be a part of dny undergrounding district which may be established by the City. including the property in question. The form of this agreement sl�all be acceptable to tFie City Attorney and shall run with the land. Triis condition stiall not be applicable to the service lines that lead directly to the building(s) which must be undergrounded. 3 � y RESOLUTION N0. 87-54 � G� Construction activlties shall not disrupt access or parking availability in President's Plaza or on tt�e frontage road. Applicant shall agree to participate in a future parking assessment created to develop additional parking spaces in President's Plaza West. Deaartment of Public Norks: � 2. Drainage and signalization fund fees, as required by City ordinance. shall be paid prior to grading permit issuance. Storm drain construction shall be contingent upon a drainage study by the private engineer that is approved by the Department of Public Works. 3. Full public improvements, including traffic safety lighting. as required by ordinance and the Director of Public Works. sf�all be installed in accordance with City standards. 4. Complete improvement plans and specifications sr�all be submitted, as required by ordinance, to the Director of Public Works for checking and approval before construction of any improvements is commenced. The engineer shall submit "as-built" plans prior to tt�e acceptance of the improvements by the City. 5. Landscaping matntenance on Larkspur Lane and Palm Desert Urive South shall be provided by the property owners. 6. Existing utilities on Larkspur Lane site shall be underqround per each respective utility district's recommendati�n. !f determined to be unfeasible applicant st�all agree to participate in any future utility undergrounding district. easement. 7. Complete grading plans and specifications shall be submitted. as required by ordinance, to the Director of Public Works for checking and approval prior to issuance of any permits. � � Dedicatlon of 2.5 feet of right-of-way on Palm Desert Drive South st�all be done prior to issuance of any permits and approval of plans. Installation of eight foot sidewalk on Larkspur Lane and Palm Oesert Drive South. 10. Close unused driveways with full height curb and cautter. 11. Offsite lmprovement plans to be approved by Pu�lic Work Department and a�surety posted to guerantee the required offsite improvements prior to grading permit issuance. " 4 �_ RESOLUTION N0. 87-54 12. Any and all off-site improvements shall be preceded by tfie approval of plans and the issuance of valid encroachment permit(s) by the Depa�tment of Public Works 13. A complete preliminary soils investigation, conducted by a registered soils engineer, shall be submitted to and approved by the Department of Public Works prior to issuance of the grading permit. 14. Installation of curb and gutter on Larkspur Lane. and handicap ramp at the curb return. City Fire Marshal: 1. Install a water system capable of delivering 300U GPM fire flow from any fire hydrant for a 3 hour duration in ad�iition to domestic supply. The computation shall be based upon a minimum of 20 psi residual operating pressure in the supply main from wf�ich the flow is measured at tl�e time of measurement. 2. Install Riverside County super fire f�ydrants so tt�at no point of any building is more than 200 feet from a fire t�ydr�ant measured along approved vehicular travel ways. a. exterior surface of hydrant barrels and heads shall be painted chrome yellow and the tops and nozzle caps shall be painted green. b. curbs shall be painted red IS feet in eitf�er direction from each hydrant. c. hydrants shall not be located closer tt�an 25 feet to any building. 3. Prior to issuance of a building permit. the developer sf�all furnish the original and three copies of the water system plan to tf�e fire marst�al for review. Upon approval. one copy will be sent to the building department and the original will be returned to the developer. 4. The water system plan shall be signed by a registered civil engineer and approved by the water company witf� tf�e following certification: "I certify that the design of the water system in PP 87-19 is in accordance with the requirements prescribed by the fire marsrial". 5. Prior to delivery of combustible materials to tfie building site. the required water system shall be installed. operating and delivering the required flow. 5 RESOLUTION N0. 87-54 6. The Director of the Department of Community Development. City of Palm Desert, California. has found that the described project will not have a significant effect on the env i ronment . A copy of the i n i t i a 1 study r�as been attached to document the reasons in support of this finding.
