1. The design of the precise plan will not substantially depreclate
property values in the vicinity.
2. The precise plan will not unreasonably interfere with the use or
enjoyment of property in the vicinity by the occupants thereof for
lawful purposes.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
PALM DESERT, CALIFORNIA, APPROVING A PRECISE PLAN
OF DESIGN TO ALLOW CONSTRUCTION OF A 21,58U
SQUARE FOOT RETAIL BUILDING IN THE C-1 ZONE ON
THE SOUTH SIDE OF HIGHWAY Ill AT THE CITY'S
WESTERN BOUNDARY.
CASE N0. PP 87-7
WHEREAS, the City Council of the City of Palm Desert, California, did on
the 25th day of June, 1987, hold a duly noticed public hearing to consider the
request of LAUREL DEVELOPMENT COMPANY for the above described project; and
WHEREAS, the Planning Cortmission did on the 16th day of June, 1987,
reconsider the request of said applicant; and
WHEREAS, said application has complled with the requirements of the "City
of Palm Desert Procedure for (mplementation of the California Envtronmental
Quality Act, Resolution No. SO-89," in that the director of community
development has determined that the project will not have an adverse impact on
the environment and a negative declaration of environmentai impact has been
prepared; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said city council did find the following facts and reasons to exist to
justify granting approval of said precise plan:

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Palm
Desert, California, as follows:

That the above recitations are true and correct and constitute the
findings of the commission in this case;
That approval of Precise Plan 87-7 is hereby granted for reasons
subject to the attached conditions.

CONDITIONS OF APPROVAL

Deaa�tment of Camiunity Develo�nent/Pla�nin9:
1. The development of the property shall conform substantially with exhiblts
on file with the departme�t of cortxnunity development/planning, as modified
by the following conditions.
2. Construction of a portion of said project shall cortxnence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null, vold and of no effect
whatsoever.
3. The development of the property described he�ein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now fn force, o�
which hereafter may be in force.
4. Prior to issuance of a buildi�g permit for construction of any use
contemplated by this approval, the applicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Cortxnission
City Fire Marshal
Public Works Department
Palm Desert Water and Services District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building permit for the use contemplated herewith.
5. Parkfng on Highway lil will be concealed from view by a 3.5 berm, a wall.
hedge, and landscaping to the satisfaction of the director of community
development/planning.
6. There will be a minimum of four feet of landscaping from the edge of the
sidewalk to pavement along Highway lll.
Department of Pub 1 i c 1�lorks :
l. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to grading permit issuance.
2. Storm drain construction shall be contingent upon a drainage study by the
private engineer that is approved by the department of public works.

3. Fuil public improvements, including traffic safety lighting as required
by ordinance and the director of public works_, shall be installed 1n
accordance wfith California Department of Transportation standards.
4. Improvement plens for water and sewer system shall be approved by the
respective service districts with "as-built" plans submitted to the
department of transportatton prior to the project f1na1.
5. Complete improvement plans and specifications shall be submitted, as
required by o�dinance, to the department of transportation for checking
and approval before construction of any improvements is commenced. The
engineer shall submit "as-built" plans prfor to the acceptance of the
improvements by the c1ty.
6. Al1 private driveways a�d parking lots shall be inspected by the
engineering department and a standard inspection fee shall be paid prior
to grading permit issuance.
7. Landscaping maintenance on State Route lll shall be provided by the
property owner.
8. Complete grading plans and specifications shall be submitted, as required
by ordlnance, to the director of public works for checking and approval
prior to issuance of any permits.
9. Dedication of five feet of right-of-way on State Highway lll shall be
done prior to issuance of any permits and approval of pians.
t0. Installation of concrete curb and gutter, matching paving and eight foot
meandering sidewalk on State Highway 111.
11. Offside improvement plans to be approved by public works department and a
surety posted to guarantee the requlred offsite improvements prior to
grading permit issuance.
12. ]nstallatton of one-half landscaped median in State Highway lll or cash
payment for one-half the cost of landscaped median at the option of the
director of public works.
13. Instaliation of sewers/septic tank to serve this project as approved by
the Coachella Valley Water District and the department of public works.
14. Si2e, number and locatlon of driveways to public works speciffcattons
with only one driveway approach to be allowed to serve this property.

l5. Any and al) off-site improvements shall be preceded by the approval of
pians and the issuance of valid encroachment permit(s) by the California
Department of Transportation.
16. A complete preliminary soils investigation, conducted by a registered
soils engineer, shall be submitted to and approved by the department of
public works prior to issuance of the grading permit.
17. Applicant shall secure reciprocal ingress and egress access easements
from the owner of lot to the north.
18. Southernmost ingress shall only be allowed upon approval of Caltrans.
Applicant must utilize existing ingressJegress to the north.
Consfderatton shall be given to the city's FAU widenfng proJect and
project design shall incorporate all aspects of said widening project.
19. Existing asphaltic concrete drainage structure shall be removed and
replaced wlth e concrete structure to tie into existing storm channel.
Applicant shail submit plans for approval and secure valid encroachment
permlts from the department of transportation and the Coachella Valley
Water District.
20. Applicant 5hall submit approved street improvement plans and proof of
payment of lands and fees from the department of transportation to the
city prior to issuance of the grading permit by the city.
21. Ali improvements within State right-of-way shall be per State Department
of Transportation standards.
Citv Fire Marshal:
l. Install a water system capable of delivering 3000 GPM fire flow from any
fire hydrant for a three hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure i� the supply main f�om which the flow is measured at the time
of ineasurement. Fire flow requirements will depend on built-in fire
protectio� provisions of buildings.
2. install Riverside County super fire hydrants so that no point of any
buiiding is more than 200 feet, or as approved by the fire marshal, from a
fire hydrant measured along approved vehicu)ar travei ways.
a. exterior surfaces of hydrant barrels and heads shall be painted
chrome yellow, and the tops and �ozzle caps shall be painted green.
b. curbs shall be pai�ted red 15 feet in either direction from each
hydrant.

c. hydrants shall not be located closer than 25 feet to any bullding.
3. Pr1or to issuance of a building permit, the developer shall furnish the
orlginal and two copies of the water system plan to the fire marshal for
review. Upon approval, one copy will be sent to the building depertment,
and the origlnal will be returned to the developer.
4. The wate� system plan shall be signed by a registered civil engineer and
approved by the water company, with the following certificatlon: "i
certify that the design of the water system in Case No. PP 87-7 is in
accordance wlth the requirements prescribed by the fire marshal."
5. Prior to delivery of combustible materials to the butlding site. the
requlred water system shali be installed, operating, and delivering the
requtred flow.

Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approval.
All buildings over 5000 square feet requlre an approved fire sprinkler
system.
Planning Commission Condition:
1. Applicant shall submit to the department of community development/planning
recommendation of plan from J.F. Davidson and Caltrans.
