CONMERCIAL BUILOING LOCATEO AT THE SOUTiiEAST

NHEREAS, the of the City of Paln� Desert. Celifornia, did on the 9th dey of
July 1987 hold a duly noticed publlc heerin� to consider approval of a precise
plen and perkin9 varience to pern�it the remodel and 4050 squere foot expnnsion
of an exlsting comme�ctal buitdin9 iocated at the southeest corner of Ei Paseo
and Hi9hwey 74; a�d
WHEREAS, satd applicatlon hes complied with the requlydaents of ths "C1ty
of Pa 1 nr Oesert Procedure� to I mpl aaent th� Cel 1 forn t s Env 1 rormenta i Qua l i ty
Act, Resolution No. 80-89", in thet the director of ca�mity developaent hee
determined thet the p�o,�ect ts a Class 2 categorlcal exception for purposes of
CEQA� and
WHEREAS, at said public heering, upon hearin� and considerin� all testt-
mony and ar9un�ent�, of all 1nte�ested pe�sons destring to bs h�erd, said
City Camc11 did find the fol�a+ing fects anci �eesons to exlst to Just}fy the
granting of said precise plan and street vacetlons
A. PRECISE PLAN:
1. The design of the proposed remodel and expansion Niil slgntficantiy
improve the overall quellty and econvmlc potentlal of the subject
a� well es adjacent properties, and Will the�efo�e not dep�ecl8te
property vaiues, �estrict the lawf�l use thereof nor will 1t present
a threet to the public health, safety or welfare.
2. The deslgn of proposed remodei will improve the area's pedestrlan
retail envirorxnent consietent with the pollcies of the Cannercial
Core Spectfic Pla�.
B. VARIANCE FINDINGS:
l. The yoal of the Palm Dese�t Camiercial Core Specific Plan is to
enhance E1 Paseo's potentlal es a hiyh quelity pedestrian retail
distrlct. The upgrading of this property as a geteway to E1 Paseo is
essential to that effort. The requtsted remodel cannot occur wlthout
the reque9ted vartance.

and ca�xwt be substantiaily corrected without some eddltional floor aree.
3. A literal interpretetion and enforcdnent of the perkln� ordlnence
would prevent the up�radln9 of this property and lfnit its use es a
retetl bulldin� for which the C-1 Cam�erclal Zo�e wes cre�eted.
4. Current and pnst studies of pnrkin� de�aends for the exlstin� buildin�
and in the viclnity indicate thet sufficfent surplus cep�ecity exists
to +�eet the needs of the expenslon end prevent any detrime►�tal
1 aip�ecte to pub 11 c he�e 1 th. sefety or �ve 1 fare.
NOW, THEREFORE. BE 1T RESOLVED by the Pianning Can�issio� of the City of
Palm Oesert, California. as follows:
1. Thet the ebove recitettons a�e t�ue and co�rect and constltute the
findln�s of the Commission in this case.
2. Thet PP 87-22 and VAR. 87-1 are hereby epproved subject to attached
condltions. '

which here�efter may be in force.
6. Prior to issuance of a bullding permit for construction of any use
contemplated by this app�oval, the applicant shall first obtain permits
and/or clearance from the following agencies:

Paln� Desert Property Ormer's Assoctation

seid district established to construct edditionel off-street perking
applicant shell be liable for the construction costs of 7 parking spaces
with a maximum ltebillty of =56,000 measu�ed in 1987 dollars..
9. Thet the applicant shall execute mutual �otnt perkin� a�reement with the
owners of the Galleria developnent guaranteetng access to the Gallerla
lot.
