CASE Np: TT 22447 WHEREAS, the Plenning Comnission of the City of Palm Desert, Callfornl8, did on the 5th day of May, 1987, hold e duly noticed public hearinfl, ahich ti+es continued to June 2, 1987, to consider the request of RESORT APARTMENTS. INC., for approval of a tentetive tract mep to e�loa, a change in the method of a+nershfp for the exi�ttng �2 one bedroom studio units contained on lot 1 tract 15734 fram cooperative apartments to airspece co�xlominlums. WHEREAS, the Planntng Commtssion on Ju�e 2, 1987, revlewed the matter and took "no action". WHEREAS, the epplicant flled a timely appeal to the "no action" taken by the Planning Commission. � WMEREAS, the C t ty Counc 11 of the C i ty of Pa 1 m Dese�t d 1 d on the 9th day of July, t967, hold a duly noticed public hearing to consider the appeal by RESORT APARTMENTS, INC. WHEREAS, said application has complled with the requlrements of the "City of Palm Desert Procedures to Implement the Californta Environiaentel Quality Act, Reso 1 ut t on No . 80-89" , 1 n that the d i rector of cornnun i ty deve 1 opnent has determined that the project is a class 1 categorical exemption for the purposes of CEQA. WHEREAS, at sald public hearing, upon hearing and considering eli testimony and arguments, if any, of all persons desiring to be heard, said City Council did find the following facts and reasons as justified in the staff report dated May 5, 1987 on file in the department of cortn�unity development, to exist to approve the tentative tract map. a. That the proposed map is conslstent wlth applicabie ge�erel and spectfic plens. b. That the design or improvement of the proposed subdivision is consistent r+ith applicable general and specific plens. c. That the site 1s physicaily suitable for the type of development. d. That the slte is physlcally suitable for the proposed density of development. e. That the design of the subdivtsion or the proposed improvements are not likely to cause substantial envirorxnente� damage or substentially and avoidably 1n�ure fish or wiidlife o� thetr hab(tat. f. That the design of the subdlvision or the type of improvement� is not likely to cause sertous public healt� problems. RE90LUTION N0. 87-68 g. That the design of the subdivisio� or the type of improvement� wiil not confllct with easements, acquired by the publtc at large, for access through or use of, property withln the proposed subdlvision. h. That the design of the subdiviston will not restrict solar access. WHEREAS, in the revteW of this tentative tract map the C1ty Council has considered the effect of the contemplated actlon on the houstng needs of the regton for purposes of balancing these needs against the public service needs of the residents of the City of Palm Desert and its environ�, with avallabte fiscal and environmental resources. NON. THEREFORE, BE IF RESOLVED by the City Council of the C1ty of Palm Desert, as follows: 1. That the above recitations are true and correct and constitute the findings of the Council in this case. 2. That it does hereby approve the ebove descrtbed Tentative Mep No. 22447 for the reasons set forth in thls resolution and subject to tho attached conditions. The development of the property described hereln shall be subject to the restrictions end limitations set forth herein whtch ere in addltion to all the requlrements, 1lmitations and restrlctions of all municipel ordinences and state and federal statutes now in force, or Nhich hereafter may be in force. 2. The applicant shall heve twenty four (24) months from the date of the approval or conditlonal epproval of the tentative +nep for filing of the final map unless an extension of time as permitted by code 1s granted by pianning comnission. 3. All dedlcated land and/or easements required by this approval shall b� granted to the City of Palm Oesert, without cost to the clty and free of all ltens and encumbrances. 4. Prior to recordation of the final subdivision map, the applicant shall submit to the city engineer. a. the document to convey title b. covenants and restrictions to be recorded c. management a�d maintenence agreement to be entered into with the o►vners of the units of the proJect.
