HomeMy WebLinkAboutCC RES 87-009RESOLUTION N0. 87-9 A RES�LUTION OF THE CITY COUNCIL OF THE CITY OF PALM DESERT, CALIFORNIA, SUSPENDING THE �PERATION OF RESOLUTION NO. 84-29 WHILE STATE SCHOOL EEE PROGRAM I S I N EFFECT . WHEREAS, the State of California has enacted Chapter 887 of the statutes of 1986 a comprehensive school fee pxogram which in practical effect requires the Desert Sands Unified School District to impose its own schooZ fees and, after January 1, 1987, preempts this City Council from continuing to impose residential development mitigation or police power fees for the same purpose; and WHEREAS, this new state school fee program contains within its provisions which will repeal that program if and when any statewide school facilities bond issue is turned down by the voters; and WHEREAS, a great deal of time and effort has gone into establishinq and implementing the current schoal mitigation and police pawer fee in effect in the City of PaZm Desert which time and effort would be wasted if that program were repealed in favor of a new state program which in itself is repealed by operation of law. N�W, THEREE�RE, THE CITY COUNCZL OF THE CITY OF PALM DESERT, CALIFORNIA, DOES HEREBY RESOLVE: Section 1: That the operation of Resolution No. � --��L/1.$.$7 84-29 is suspended from and after January 1, 2987, unless and until the provisions of Chapter 887 of the Statutes of 1986 are repealed by operation of law. Section 2: That if Chapter $87 of the Statures of 1986 is repealed by operation of law, the provisions of Resolution No. 84-29 shall immediately return to full force and effect, provided, a. the City receives written request therefor in writing from the Desert Sands Unified School District, and b. the City receives a signed hold harmless agreement by Desert Sands Unified School District in a form acceptable to the City Attorney.
