A RESOlUTION OF THE CITY COUNCIL OF THE CITY OF PALM
DESERT, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL
APPROVAL OF A GENERAL PLAN AMENDMENT, PRECISE PLAN AND
TENTATIVE TRACT MAP FOR 404 ACRES OF LAND AT THE NORTHEAST
CORNER OF Cf)OK STREET AND COUNTRY CLUB ORIVE.
CASE NOS. GPA 87-3, PP 87-26, ANO TT 22690
WHEREAS, the City Council of the City of Palm Desert, California. did on
the Sth day of October, 1987. hold a duly noticed public hearing to consider
the request of TEMPLE DEVELOPMENT CUMPANY for approval of a Genera) Plan
Amendment, Precise Plan of Design and Tentative Tract 22690 to change the land
use designation from very low density t� low density residential for 404 acres
located at the northeast corner of Cook Street and Country Club Drive. more
particularly as:
APN's 619-880-001. 002, 004. 005, 007, 008. 011, Ol4
WHEREAS, said application has complied with the requirements of the "City
of Palm Oesert Procedure for Implement of the California Environmental Quality
Act, Resolution No. 80-89," in that the directo� of cortmunity development has
determined that the project has been previously assessed in connection with
Case Nos. DP 09-79 and TT 15000 and no further documentation is deemed
necessary by the director; and
WHEREAS, at said public hearing, upon hearing and considering all
testimony and arguments, if any, of all interested persons desiring to be
heard, said city council did find the following facts and reasons to exist to
justify granting approval of this request:
l. Low density designation of this site would be compatible with the
surrounding land uses whir_h are primarily multiple family zoned at a
higher density.
2. The proposed amendment will far_ilitate developme�t by creating a
density that, based u�n available land and ronstruction cost data.
is required to make the project viable.
NOW, THEREFORE. BE [T RESOLVED by the City Council of the City of Palm
Desert, California, as follows:
I. That the above rPcitations are true and c�rrect and constitute the
findings of the councii in this case;
2, That General Plan AmendmPnt 97-3 from very lnw density to inw density
residential per the arrache�i exhibit "A" is hereby approved.
3. That Oevelopment Plan A7-26 and fentative fract Map 2269U are
�pproved subject to the conditions set torth in exhibit "B."

EXHIBIT "8'
Pa1m Desert City Council conditions of approval for Precise Plan 87-26 a�d
Tentative T�act Map 22690.
I. Al1 condltlons of approval setforth in Planning Commission Resolutions
i251, attached hereto as exhibit "C."
2. Median landscaping will be compieted in four phases to coincide with
improvements and phases setforth in condition 12 of Palm Desert Planning
Commission Resolution 1251. Applicant shall install fuli median
landscaping and be retmbursed at the time development occurs on the east
side of Cook Street or north side of Frank Sinatra. Reimbursement will
be for 1/2 actual costs only and no interest or other charges w111 be
placed on subsequent developments.
3. Applicant shall reimburse the city for all funds expended by the city for
the construction of Cook Street; Prior to conmencing construction of
Phase I, u�less otherwise agreed to by the Palm Desert City Counctl.
4. PP 87-26 shail be modified to provide a significant landscape and water
feature treatment at the southeast co��er of F�ank Sinatra Drive and Cook
Street. Plans for said treatment shell be submitted for approval by the
Palm Oesert Architectural commission p�ior to comrnencing constructlon 1n
Phase lil.
5. Present visual openings 1n the wall along Cook Street shall be retained.
6. Medlans on Cook Street and F�ank Sfnat�a Drlve will be landsceped in a
man�er ca�atible and similar to those in front of the Coliege of the
Desert along Fred Maring Dr1ve (desert drought tolerant treatment).
7. Developer will add an ingress and egress along Frank Sinatra Drive if
required by C1ty of Palm Desert.
8. Developer or his assignees ag�ee to participate i� the construction of a
traffic signal at its Country Ciub entrance when determined necessary by
the City of Palm Desert.
9. These condltions and those setforth in Palm Desert Planning Cortmission
Resolutlon 1251 attached hereto as exhibit "C" shall be recorded with the
Riverside County Recorder and evidence of same given to the Palm Oesert
City Clerk prior to recordation of any final maps on Precise Plen 87-26.

Oepertn�ent of CawMm i ty Deve 1 op�ent :
l. The develoPment of the property shall conform substantially with exhibits
on file with the department of community develc�pment/planning, as modified
by the following conditlons.
2. Construction of a portion of said project shall cortmence within one year
from the date of final approval unless an extension of time is granted;
otherwise said approval shall become null. void and of no effect
Nhatsoever.
3. The development of the property described herein shall be subject to the
restrictions and limitations set forth herein which are in addition to
all municipal ordinances and state and federal statutes now in force, or
which hereafter may be in force.
4, Prior to issuance of a building permit for construction of any use
contemplated by this approval� the appiicant shall first obtain permits
and/or clearance from the following agencies:
Coachella Valley Water District
Palm Desert Architectural Commission
City Fire Marshal
Public Works Oepartment
Palm Desert Water 8 Services District
Evidence of said permit or clearance from the above agencies shall be
presented to the department of building and safety at the time of issuance
of a building pe�mit for the use contemplated herewith.
5. A secondary and emergency acress will be incorporated into the site
design.
6. Wind/blow sand planting and protection will Ce provided to the
satisfaction of tha dire�tor of cortmunity devel�pment.
7. One story units will be provided along the eastern property line except
for the first 425 feet f�rom Country Club Drive. where two st_c�ry units may
tocate.
8. Complete plans for the golf clubhouse shall be submitted and reviewed
prior to issuance �f a huilding permir.

9. Additional trash enclosures shali be approved by the city a�d local
dlsposal cortipa�y prior to issuance of building permit.
10. Project shell pay fees as determined by Desert Sends Unified School
District.
I1. This project sha)1 pay fire facilities fees per city code.
12. The perimeter ►+all will be moved to the base of slope.
l3. Buildings will be no larger than four-plex clusters.
14. Only enclosed garages shall be ailowed for the covered parking requirement
(no carports>.
Deoa�t�ent of Ptb 1 i c i�orks :
1. Drainage and signalization fund fees, as required by city ordinance,
shall be paid prior to recordation of the final map.
Z. Drainage facilities shall be provided. per Ordinance No. 2l8 and the
Master Drainage Plan, to the specifications of the director of public
works.
3. Starm drain construction shail be contingent upon a drainage study by the
private engineer that is approved by the depa�tment of pubiic works.
4. Compiete improvement plans and specificatio�s shall be submltted, as
required by ordinance, to the director of public works for checking and
app�ova 1 before construct i on of any improvert�ents 1 s coim�enced. The
engineer shall submit "as-built" plans prior to the acceptance of the
imp�ovements by the city.
5. All prlvate streets, driveways, and parking lots shall be inspected by
the enginee�ing department and a standerd inspection fee shall be peid
prior to grading permit issuance.
6. Landscaping mainte�ance on Country Club Drive. Frank Sinatra Drive, and
Cook Street shall be provided by the homeowner's essociation.
7. Existing utilities shall be undergrounded per each respective utllity
district's recommendation. If determined to be unfeasible applicant
shall agree to participate in any future utility undergrounding district.
8. Complete grading plans and specifications shall be submitted, as requlred
by ordinance, to the director of public works for checking and approval
prior to issuance of any permits.

9. Full improvement of interior streets based on private street standards as
established in accordance with Chapter 26, Section 26.40.040, C.P.O. Code.
t0. Complete tract map shali be submitted as required by ordinance to the
director of public rrorks for checking and approval a�d be recorded before
issuence of any permits.
il. A complete preliminary soils investigation, conducted by a registered
soils engineer. shall be submitted to and approved by the department of
public works prio� to issuance of the grading permit.
12. Full offsite improvements including, but not limited to, curb, gutter,
asphalt paving, sidewalk, median island and landscaping shall be installed
in phases as follows:
Phese I: Full improvements on Cook Street for a dista�ce of 500
feet north of Country Club Orive.
Phase II: Full improvements on Cook Street 500 feet south of Frank
Sinatra Drive and full improvements on Frank Sinetra Orive
500 feet east of Cook Street.
Phase [I[: Full improvements on the balance of Cook Street.
Phase IV: Full improvements on the balance of Frank Sinatra Drive.
CitY Fire Ma�shel:
l. Install a water system capable of delivering 2500 GPM fire flow from any
fire hydrant for a two hour duration in addition to domestic supply.
The computation shall be based upon a minimum of 20 psi residual operating
pressure in the supply main from which the flow is measured at the time
of ineasurement. -
2. Install Riverside County super fire hydrants so that no point of any
building is more than 250 feet from a fire hydrant measured along approved
vehicular travel ways.
a. exterior surface of hydrant barrels and heads shall be painted
chrome yellow. and the t�ps and nozzle caps shall be painted green.
b. curbs shall be painted red 15 feet in either direction from each
hydrant.
c. hydrants shall not be located closer than 25 feet to any building.
3. Prio� to issuance of a building permit. the developer shall furnish the
original and three ropies of the water system plan to the fire marshal
fo� review. Upon approval, one copy wili be Sent to the bu11d1ng
department and the original will be returned to the developer.

4. The weter system plan shall be signed by e registered civil englneer and
approved by the water company with the following certlflcation: "I
certify that the design of the water system in PP 87-26 is in accordance
with the requirements prescribed by t�e f1�e marshel."
5. Prior to delivery of combustible «+aterials to the building site. the
required water system shall be installed, operating and delivering the
required fiow.
6. Additional fire protection requirements may be necessary when the
applicant submits specific plans for consideration and approvai.
7. Must have secondary emergency access.
